BOOKING CONDITIONS Booking conditions
The following Booking Conditions together with the information contained in the Advice and Information, Large Small Print and Booking Information sections and all other general information found in our brochure form the basis of your contract with The Caravan Club, of East Grinstead House, East Grinstead, West Sussex, RH19 1UA. All bookings are subject to these booking conditions. Please read these carefully as they set out our respective rights and obligations.
In these Booking Conditions, ‘you’ and ‘your’ means all persons named on the booking (including anyone who is added or substituted at a later date). ‘We’, ‘us’ and ‘our’ means The Caravan Club.
We act as an agent for ferry operators, Eurotunnel and campsite operators for whom we effect reservations. Bookings may be made through us as follows:-
For ferry/Eurotunnel travel only For campsite accommodation only
For a ferry or Eurotunnel booking together with a campsite booking, where each of the elements is available for purchase individually through ourselves, as agents, at the same price.
These will be governed by the terms and conditions of each of the ferry, Eurotunnel or campsite operators and your contract will be with each of these suppliers. These bookings are known as type A Bookings.
PACKAGE HOLIDAYS A ‘package holiday’ is deemed to exist where the following circumstances apply:-
A holiday which consists of at least two elements from a) transport, b) accommodation or c) other tourist services (not ancillary to any transport or accommodation and forming a significant part of the arrangements) where they are all booked through us at the same time and where we act as a supplier rather than agent and/or special prices apply which are less than if the products were purchased separately.
If you book a Package Holiday through us and it is confirmed, we will then accept responsibility for it in accordance with these Booking Conditions as an ‘organiser’ under the ‘Package Travel, Package Holiday and Package Tour Regulations 1992’ and as amended. These bookings are known as Type B Bookings.
MAKING YOUR BOOKING 1. By making the booking the party leader confirms that he/she accepts and agrees to be bound by these conditions and that he/she has the authority of all those in his/her party to make the booking on their behalf. Once we have received your booking and all appropriate payments (see clause 2 below), we will, subject to availability, confirm your holiday by issuing a confirmation invoice. This invoice will be sent to the party leader. Please check this invoice carefully as soon as you receive it. Contact us immediately if any information which appears on the confirmation or any other document appears to be incorrect or incomplete as it may not be possible to make changes
later. We regret we cannot accept any liability if we are not notified of any inaccuracy in any document within 7 days of our sending it out. We will do our best to rectify any mistake notified to us outside these time limits but you must meet any costs involved in doing so. Where we act only as agent (Type A bookings) we will have no responsibility for any errors in any documentation except where those errors were made by ourselves. Any acceptance of such responsibility will also be subject to the time limits and other exceptions set out in this clause.
PAYMENT 2. To confirm your booking, you must pay a deposit of £75 per party (or £175 per party if booking certain tours or full payment if booking within eight weeks of departure) at the time of booking. Depending on your booking, some ferry operators may require a higher deposit at the time of booking or full payment more than eight weeks before departure and you will be advised of this at the time of booking. If you wish to purchase the Red Pennant Insurance policy we offer (or Red Pennant Insurance is compulsory for the holiday you have chosen – see applicable holiday description), all applicable premiums must also be paid at the time of booking. See also clause 11 – ‘Insurance’. Full payment of the balance must be received by the 'Balance Due' date shown on your confirmation invoice. If we do not receive payment of all monies due (including any surcharge) in full and on time we on behalf of the transport operator or campsite owner (if you have booked a Type A booking), or we ourselves (if you have booked a Type B booking), will cancel your booking and retain any deposits paid by you. When accepting any booking within eight weeks of departure date we reserve the right to ask you to pay the full cost of your booking. We accept the following methods of payment: debit card or credit card authorisation. NB: No tickets or other documentation will be forwarded until all invoiced balances have been paid.
YOUR CONTRACT 3. A binding contract between you and the transport operator or campsite owner (if you have made a Type A booking), or between you and us (if you have made a Type B booking) comes into existence when we despatch the confirmation invoice to the party leader. This contract and all matters arising out of it are governed by English law. We both agree that any dispute, claim or other matter which arises out of or in connection with your contract with us and all matters arising out of it will be dealt with by the Courts of England and Wales only.
PRICES 4 (a) Type A bookings only. As we act only as agent for the transport operator or campsite owner with whom your contract is with, we reserve the right to pass on to you in full all additional costs and charges of whatever nature imposed by the transport operator or campsite owner concerned in accordance with its own terms and conditions.
(b) Type B bookings only. Our prices were calculated on 1 October 2010 on the basis of then known costs and exchange rates of £1 to €1.19. Our prices also include any local tourist taxes where applicable.
We reserve the right to increase or decrease the prices of unsold arrangements at any time. We also reserve the right to make changes to and correct errors in advertised prices at any time before your arrangements are confirmed. The price of your chosen arrangements will be confirmed at the time of booking.
The prices stated in this brochure are based on a contract between The Caravan Club and the site concerned only. To be able to take advantage of these prices a booking must be made with The Caravan Club.
Once the price of your chosen arrangements has been confirmed at the time of booking, then, subject to the correction of errors, we will only increase or decrease the price in the following circumstances. Price increases or decreases after booking will be passed on by way of a surcharge or refund. A surcharge or refund (as applicable) will be payable, subject to the conditions set out in this clause, if transportation costs or dues, taxes (for example VAT) or fees payable for services such as embarkation or disembarkation fees at ports increase or decrease. Even in the above cases, only if the amount of the increase in our costs exceeds 2% of the total cost of your arrangements (excluding insurance premiums and any amendment charges), will we levy a surcharge. If any surcharge is greater than 10% of the cost of your arrangements (excluding insurance premiums and any amendment charges), you will be entitled to choose one of options (a), (b) or (c) set out in clause 6 (b) below. You have 14 days from the issue date printed on the surcharge invoice to tell us if you want to choose option (b) or (c) as set out in clause 7 (b) below. If you do not tell us that you wish to choose either of these options within this period of time, we are entitled to assume that you do not wish to do so and will pay the surcharge. Any surcharge must be paid with the balance of the cost of the arrangements or within 14 days of the issue date printed on the surcharge invoice, whichever is the later.
A refund will only be payable if the decrease in our costs exceeds 2% as set out above. Where a refund is due, we will pay you the full amount of the decrease in our costs. We promise not to levy a surcharge within 30 days of departure.
ALL ARRANGEMENTS 5. Many transport operators are now using ‘Flexible Pricing’. This effectively means that prices can and do vary on a daily basis for the same arrangements. Consequently, where we give a quotation for a particular journey, this is only valid at the time of quoting. Any booking made at a later time may be at a different rate. We reserve the right to correct errors in both advertised and confirmed prices. We will do so as soon as we become aware of the error. Please note, changes and errors occasionally occur. You must check the price of your chosen arrangements at the time of booking.
CONDITIONS OF SUPPLIERS 6. Many of the services which make up your booking are provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the supplier's liability to you, usually in accordance with applicable International Conventions (see clause 9 (4)). Copies of the relevant parts of these terms and conditions are available on request from ourselves or the supplier.
ALTERATIONS AND CANCELLATIONS BY TRANSPORT OPERATORS/CAMPSITE OWNERS/US 7 (a) If the transport operator or campsite owner changes or cancels your Type A booking. If there is a change to your Type A booking we will pass on the new details to you together with any compensation that the transport operator or campsite owner may offer. As agent only for the transport operator or campsite owner we cannot accept any liability for any changes or cancellations made to these bookings.
