A N article in last week’s Clitheroe Advertiser and Times reported that Clitheroe-based conservatory giant Ultraframe had lost a High Court patent battle with a rival company, Eurocell. The information contained in a


press release from Eurocell, was strictly true, but it transpires that far from losing the court battle, Ultraframe is.delighted with the outcome of the case, which rein­ forced its patent and design rights and will see Eurocell paying sub­ stantial damages and legal costs to Ultraframe. Ultraframe Group technical


director Chris Richardson (pic­ tured) said that Derbyshire-based Eurocell was previously a cus­ tomer of Ultraframe, distributing its Ultralite 500 conservatory roofing system. In 2002 it began to make and sell its own compet-' ing system, “ Pinnacle 500”. Ultraframe sued, alleging that


the Pinnacle system was a copy of the Ultralite system and infringed both its patent and design rights. Eurocell claimed that the


Ultraframe patent was invalid and a lengthy and complex legal battle began, culminating in the High Court judgement on July 22nd. Mr Justice Lewison ruled that


the Eurocell system had not infringed any Ultraframe patent. He also ruled that both Ultra­ frame’s patent and its “unregis­ tered design right” to the Ultra­ lite 500 system were valid and that the Eurocell system had infringed that unregistered design right.


Consequently, he ruled that


Eurocell must pay Ultraframe’s legal costs, with £125,000 to be paid now and the rest assessed over the coming months. The judge ruled that the com­


pany must pay damages to Ultra­ frame, relating to the amount of business lost by the Clitheroe company as a result of the com­ peting Pinnacle system, which infringed its design right. The exact amount of damages


Air ambulance used after biker accident


A MOTORCYCLIST was flown to hospi­ tal after his bike collided with a tractor and trailer on the narrow road from Saw- ley towards Settle on Friday morning. The 49 year-old man from Darwen


came off his bike and suffered what are thought tp be minor injuries to his back. He was flown by air ambulance to hospi­ tal to the Blackburn Royal Infirmary. The air ambulance charity is running a


campaign urging drivers and farmers to take extra care on country roads.

invalid, as Eurocell had claimed, that could have opened the door to a free-for-all for rivals to start copying and selling Ultraframe’s unique and innovative design. “We are delighted with the out­


come of the case,” said Mr Richardson. “We invest between two and


three million pounds a year in research and development and we are determined to protect our groundbreaking designs. “We are very pleased to have


been successful and I would like to thank everyone who helped us, particularly all the people from Ultraframe who gave evidence during the case.”

Annual show


Plans are well advanced for Sabden Horti­ cultural Society’s annual show later this month


Saturday, August 21st, and St Mary’s Hall, Whalley Road, is the venue and people from outside the village are very welcome to enter any of the 107 classes or just come along to enjoy the exhibits. There are classes for flowers, vegetables, adults and children’s handicrafts and art, baking, wine, flower arranging, photogra­ phy and eggs, so there is something for everyone.


Schedules have been distributed around the village or are available in the shops outlin­ ing all the classes and details.

Concert


This year’s Christian Aid concert in Sabden takes place on Friday, October 22nd, in St Mary’s Hall. Demand for tickets out­ stripped supply last year so names of those wanting them should be left at each church or with Christian Council members.


Entertainment is by Tony Berry, lead singer with the Houghton Weavers.
