The Small Claims Procedure (Court) Part of the District Court. Cheap, fast and easy way for consumers to resolve complaints. Judge listens to both sides and makes a decision. Maximum compensation is €2,000.
Consumers can make claims because of faulty goods, bad workmanship, minor damage to property. Businesses can make claims against other businesses. The Ombudsman
The Ombudsman hears and investigates complaints made by private individuals against government bodies or offices.
Established to investigate complaints against government departments. Can investigate 180 public bodies. Independent, impartial and free service. There are other types of Ombudsman: • Financial Services Ombudsman deals with financial institutions and insurance companies.
• Ombudsman for Children promotes the rights and welfare of children and young people up to 18 years old.
European Consumer Centre Ireland (ECCI)
A support for consumers who have bought goods or services in another EU member state.
Provides free information, advice and assistance to consumers. The Irish centre is just one of an EU-wide network. Raises awareness of consumer rights.
Trade Associations
A trade association is an organisation that represents all the businesses that sell a particular type of product or service.
Trade associations develop codes of conduct (rules) for members to follow. Consumers can complain to the relevant trade association. Examples of trade associations:
• Irish Health Trade Association (IHTA) represents interests of manufacturers, importers and distributors of specialist health products in Ireland.
• Irish Travel Agents Association (ITAA) represents travel agents and tour operators.
Commission for Communications Regulation (ComReg) Deals with complaints against communications organisations.
Examples: An Post, phone and broadband providers such as Eir or Virgin media.
