After sealing approval from the Constitution and Justice Committee, bill PL 2234/2022 is heading to the Senate Plenary for analysis.

Argentina - Relocate casinos to ski resort? Councillor Leandro Costa Brutten has presented a draft ordinance, co-authored by his counterpart Julieta Wallace, in the Municipal Council of Bariloche, which aims to remove casinos from the centre of the city in the province of Río Negro and move them to the ski resort of Cerro Catedral.


According to Costa Brutten, this is not a “prohibition,” but a relocation to make them “exclusively associated with the tourist offer.” This way, “gambling addiction in Bariloche is decisively confronted and a regulation is established that discourages the daily loss of family income in gambling,” he said in statements to local press.


Currently, two establishments operated by the company Casino Club, under provincial concession, are operational in Bariloche. The initiative seeks to reconfigure the "gaming halls" sector, which currently has no geographical restrictions.


The Casino Club locations are situated in the city centre. If the proposal is approved, Casino Club could legally oppose it, as the company has the right to operate throughout the city without restrictions until 2040 and has a fixed provincial fee of $US4.2m, a payment that will be allocated to the construction of the city's new bus terminal. Co-Author Councillor Wallace, on the other hand, stated that she would request her name be removed from the initiative, as she does not fully endorse its content.

Te Constitution and Justice Committee has approved, by 14 favourable votes and 12 against, PL 2234/2022. Te proposal now moves on to the Senate Plenary for analysis. Te rapporteur, Senator Irajá argued that it was an opportunity for income and jobs and a way to bring activities operating on the fringes of the law into legality.


“We will collect from these currently illegal and clandestine games, which are operating in the shadows – where we currently collect absolutely nothing – around R $2bn annually. Of course, this revenue will be divided among the states, municipalities, and the Union,” he said according to the Senate Radio news agency.


Senator Carlos Portinho however, pointed out that the sports betting law, had not yet translated into benefits because the government is taking too long to regulate the legislation.


“Six months later, what’s the result? Everything remains exactly as before – the government has not regulated a single line. Terefore, bets


continue as before, not paying taxes or licensing fees. So, all the government’s discourse that it was important to regulate because this would result in revenues was not true, is not true.”


According to the text of the bill, casinos may be installed in resorts as part of an integrated leisure complex that must contain at least 100 high-end hotel rooms, meeting and event venues, restaurants, bars and shopping centres. In order to determine where casinos can be opened, the Executive Branch must consider the existence of the tourism industry and the economic and social potential of the region.


According to the proposal, gaming houses will also be able to operate on sea and river vessels. Each economic group may hold only one licence per state, and licensing will be carried via a public bidding process which be decided on the technical and financial bids put forward by potential operators.Te law also permits municipalities and the Federal District to license bingo halls.


Brazil São Paulo government aims to raise R$3.4bn


Te São Paulo government plans to allocate the projected R$3.4bn revenue from state lotteries to the health sector. Te lottery model will be introduced through a new 15-year concession, with the tender scheduled for October. Te project mandates that the funds be invested in essential areas to reduce social vulnerability, with health being the initial focus.


"Tis auction is important because it generates substantial revenue for the state. It will be used entirely for health, a sector increasingly pressured by the aging population and demanding more resources," said Governor Tarcísio de Freitas.


Te state lottery model was authorised by the Supreme Federal Court (STF) in 2020, which ruled that the federal government could not monopolise the service. In São Paulo, the system was approved in 2022 by the Legislative Assembly (Alesp) to provide new funding sources for public health and education infrastructure.


According to a government press release the São Paulo concession underwent public consultation and is among the state projects set for auction this year.

Te company that wins the concession will choose which specific lottery models to implement. Te service will be available both physically and online.


Te operator must install at least 31 exclusive sales points across São Paulo's administrative regions, aiming to serve as flagship stores for the services and reach all state regions. Te installation of exclusive sales points will follow certain rules, such as being in highly visible locations with high foot traffic.


Argentina


Te Union of United Consumers (UCU) of Argentina has filed the first collective lawsuit against the online gambling and sports betting industry, targeting the BetWarrior platform. Te UCU focuses on the claim that “sign- up bonuses” constitute “a dangerous strategy for public health.”


Te UCU argues that BetWarrior offers welcome bonuses to users of legal age, meaning that there are financial incentives to gamble. Te plaintiffs pointed out that the Civil Code prohibits advertisements harmful to health.


BetWarrior is authorised to operate in several provinces, including Buenos Aires, Mendoza, and Jujuy. It also has sponsorship agreements with the Argentine Football Association, the Argentine Hockey Confederation, and the Argentine Tennis Association. Te lawsuit was filed before a court in the City of Buenos Aires and seeks the cessation of certain types of advertisements.
