Metropolitan – Negotiation on ‘Private Life’ Restrictions
Introduction The Metropolitan Police Federation (Met Fed) identified that the Metropolitan Police Service (MPS) was imposing restrictions on officers under gross misconduct investigations, which were believed to breach Article 8 of the European Convention on Human Rights (ECHR).
Description
Officers accused of non-criminal or historical domestic incidents were subjected to restrictions that prohibited direct or indirect contact with their current or former partners. These restrictions severely interfered with officers’ childcare arrangements and personal lives.
Resolution BACK TO NATIONAL VIEW London
The Met Fed initiated Judicial Review proceedings. The case was first heard in the Administrative Court, where it was determined that the MPS had unlawfully used Regulation 11 of the Police Conduct Regulations 2020 but could rely on the Police Reform and Social Responsibility Act for such restrictions. This decision was appealed to the Court of Appeal.
Outcome
The Court of Appeal ruled that these restrictions could only be applied in very high-risk domestic violence cases, setting a precedent to protect officers’ private lives while ensuring appropriate safeguards in exceptional circumstances.
INFLUENCING Metropolitan – Influencing on the IOPC
Introduction The Federation submitted written and oral evidence to the Home Affairs Select Committee and the Police and Crime Committee at City Hall, addressing concerns about the Independent Office for Police Conduct (IOPC).
Description
The IOPC is a controversial organisation within policing. The Federation used these opportunities to advocate for independent oversight that is effective and fit for purpose, while highlighting specific areas where the IOPC requires reform. This included presenting detailed examples of procedural inefficiencies and failures that negatively impact both officers and the public.
Resolution
Comprehensive written and live evidence was presented, articulating the Federation’s stance on the IOPC’s shortcomings and the need for reform.
Outcome
The Federation’s position was formally published, reassuring members that the issues with the IOPC are being actively challenged.
