Cleveland – Serious Injury by Driving Case
Introduction In May 2022, a police officer faced charges of causing serious injury by careless driving, leading to a protracted investigation by the IOPC.
Description
During a shift, the officer was involved in a low-speed collision with another vehicle, resulting in significant injuries to both parties. Despite personal injuries sustained in the collision, the officer heroically rescued two occupants from the burning vehicle, saving their lives.
The officer faced both criminal and misconduct allegations, compounded by procedural errors and prolonged delays in the investigation.
Resolution
Legal representation funded by the Police Federation demonstrated significant flaws in the investigative process. The officer was fully exonerated in court.
Outcome
The officer was found not guilty, and misconduct proceedings were dismissed. The case highlighted errors in the IOPC process and became part of a national review. The officer was subsequently honoured with a Police Bravery Award in 2024 for their life-saving actions.
Durham – Misconduct Process Support Introduction
A uniformed officer faced a misconduct investigation following their attendance at a reported disturbance.
Description
The officer responded to reports of a disturbance and made an arrest at the scene. While collecting evidence, some items were deemed impractical to retain and were appropriately disposed of, with the remaining evidence documented. However, the force’s Professional Standards Department (PSD) asserted that all evidence should have been retained. This led to allegations of a breach of duty and responsibilities related to the diligent execution of their role, resulting in a misconduct proceeding.
Resolution
The Police Federation representative supported the officer throughout the process, carefully reviewing the disclosure bundle from PSD and formulating a detailed response under Regulation 18. The representative also provided guidance during formal interviews, ensuring the officer’s rights and actions were appropriately defended.
Outcome
Thanks to the comprehensive response and evidence provided by the Federation representative, the matter was resolved through a Reflective Practice Review Process (RPRP), avoiding formal misconduct sanctions. Without this representation and support, the officer could have faced a disproportionately severe outcome. The Federation’s early involvement ensured the case was handled fairly and appropriately.
