Lincolnshire – Allegation of Assault During Robbery Response Introduction
In January 2023, an officer faced allegations of assaulting a member of the public while responding to a robbery, resulting in criminal charges and gross misconduct proceedings. The officer was acquitted in February 2024, but disciplinary investigations continued until August 2024, when the case was finally concluded with no further action (NFA).
Description BACK TO NATIONAL VIEW Eastern
While on duty, the officer responded to a robbery report and identified two males matching the description of the suspects. Upon challenging them, resistance ensued, leading the officer to draw a Taser and use a distraction strike, which resulted in a broken nose for one individual. A complaint was lodged, triggering a criminal investigation and subsequent charges of Actual Bodily Harm. Despite the officer’s acquittal, misconduct proceedings were pursued by the force.
Resolution
The Federation provided comprehensive legal support, including a barrister for the criminal trial and ongoing representation throughout the misconduct process. The officer’s Federation representative regularly highlighted the trial judge’s comments recommending the case not proceed further.
Outcome
The officer was acquitted at trial, with the judge praising their exemplary service and good faith actions. Despite the force’s attempts to escalate the matter to a gross misconduct hearing, the Deputy Chief Constable ultimately decided to take no further action.
Norfolk – Ill-Health Retirement Support Introduction
A member injured during duty, sustaining serious musculoskeletal injuries, required assistance through a prolonged ill-health retirement (IHR) process.
Description
The officer, unable to continue serving due to their injuries, faced challenges, including reduced pay during medical leave and delays in the IHR process. The Federation supported them through attendance support meetings, pay appeals, and medical assessments while negotiating suitable duties to retain their salary.
Resolution
Despite an initial refusal for IHR, the Federation guided the member through a successful appeal to the Police Medical Appeals Board (PMAB). The member also successfully applied for the Industrial Injuries Defined Benefit Scheme (IIDB) and received grants for home modifications to address mobility needs.
Outcome
The member was granted a higher-tier medical pension, ensuring financial stability. They expressed immense gratitude for the Federation’s support, which allowed them to retire comfortably and continue supporting their family without financial worry.
Northamptonshire – Supporting an Officer During a Mental Health Crisis
Introduction
The Police Federation represented and supported an officer who experienced a suicide attempt during an investigation into allegations of gross misconduct.
Description
Following the officer’s suicide attempt, they were discharged from a Section 136 Mental Health Act (MHA) Suite. The Federation was asked to assist with their welfare and provide advocacy during related investigations.
The officer faced allegations of harassment (sending a suicide note) and misconduct in public office (relating to a historical affair with a member of the public five years prior). The Federation provided comprehensive support, including attending meetings with the Force Doctor, addressing mental health concerns, and accompanying the officer to criminal and misconduct interviews. After several months, both the criminal and misconduct allegations were dismissed due to insufficient evidence.
Resolution
The sole remaining issue was the officer’s failure to disclose a notifiable association, which was addressed at a misconduct meeting. The Federation provided representation throughout this process.
Outcome
The misconduct case was not proven, and the matter was resolved through a Reflective Practice Review Process (RPRP). The Federation’s advocacy ensured the officer received appropriate support and a fair outcome.
