Humberside – Excessive Use of Force Case


Introduction In 2023, an officer faced allegations of excessive use of force while working in a custody suite.


Description


The officer responded to an incident where a detainee broke free and resisted detention, requiring intervention. CCTV footage captured the officer using a punch and knee strike to subdue the detainee. Statements from an officer safety trainer, who had no operational experience, labelled the force excessive.


The Federation representative challenged the investigation and expert testimony, obtaining character references from custody staff across the force, highlighting the officer's professionalism.


BACK TO NATIONAL VIEW North East Resolution


Detailed mitigation was presented, emphasising that the officer's actions were proportionate and justified under the circumstances.


Outcome


The case was dismissed at the misconduct meeting, with the panel finding no case to answer. The Federation representative was commended for their robust defence, and the investigation was criticised for its inadequacies.


Northumbria – Honesty and Integrity Case


Introduction In December 2021, two officers were accused of breaches related to honesty and integrity and duties and responsibilities following an incident involving the arrest of a juvenile.


Description


The officers arrested a juvenile male for possession of a bladed article. During processing, a packet of suspected drugs was seized but inadvertently omitted from their statements. The oversight was discovered by their supervisor, who accused the officers of deliberately concealing the evidence.


Both officers were interviewed, denying dishonesty but acknowledging the oversight. The case proceeded to a gross misconduct hearing in 2024.


Resolution


The Federation provided legal and procedural support for over 3.5 years, ensuring a fair and robust defence. Outcome


One officer received a written warning for a breach of duties and responsibilities, while the other officer was exonerated.
