South Yorkshire – Failure to Arrest Case


Introduction In 2023, a police officer was accused of failing to arrest a domestic violence (DV) offender who later committed a double homicide.


Description


The officer, alongside colleagues, was accused of failing to apprehend a DV offender who escaped custody. The case alleged falsification of the crime report when submitting a wanted file. Tragically, the offender later committed a high-profile double murder. The matter was debriefed by supervisors and referred to the Independent Office for Police Conduct (IOPC). Initial investigations identified gross misconduct; however, after a review, the IOPC downgraded the matter to misconduct.

Further investigation revealed that the officer faced allegations based on procedural failures attributed to another officer who had been dismissed previously. The case primarily focused on assumptions regarding the impact of a missing identification statement, which contradicted force policies.


Resolution


Through inquiries and representation, it was revealed that decisions in the case were based on flawed investigative processes.


Outcome


The officer was cleared of misconduct charges, with only Performance Review Intervention (PRI) recommended.


West Yorkshire – Driving Incident Case


Introduction In July 2022, an officer was served a Notice of Intended Prosecution (NIP) and gross misconduct (GM) papers for a driving-related incident involving alleged careless driving, speeding, and failing to comply with traffic signals without a valid operational purpose.


Description


The incident occurred while the officer was blue lighting back to the station after completing a shift. There was an honesty and integrity element in the misconduct papers, based on claims by a supervisor that the officer had failed to submit a required form for vehicle recovery, despite the officer's assertion that the form had been completed.


After detailed representations and submission of supporting evidence, including a copy of the completed form, the honesty and integrity allegation was removed, and the case was reclassified as misconduct.


Resolution


The Federation representative worked with the officer to submit a comprehensive response to the GM papers, successfully challenging the integrity-related accusations.


Outcome


The case was resolved as misconduct, avoiding a GM hearing. The officer, who had been under significant stress for nearly two years, expressed relief and gratitude for the support received.
