Dyfed Powys – Criminal and Disciplinary Case
Introduction
In 2019, a police sergeant (PS) was arrested for an off- duty matter during a work-related social event. Description
The sergeant faced allegations of common assault during the event, which resulted in a caution. The case was referred to the Crown Prosecution Service and, concurrently, an accelerated misconduct hearing was held, leading to the sergeant's dismissal. The sergeant later successfully contested the case in court and was found not guilty. A Police Appeals Tribunal (PAT) overturned the dismissal decision, leading to reinstatement. A subsequent misconduct hearing resulted in a written warning.
Resolution
Federation representation, supported by a barrister, successfully overturned the initial dismissal decision through the PAT.
Outcome
The officer was reinstated, received back pay for the period of dismissal, and resolved the matter with a written warning.
