FANTASY SPORTS & ESPORTS

An Illinois High Court has ruled that fantasy sports bets do not constitute gambling, ending a case which began four years ago after two Illinois residents, Colin Dew-Becker and Andrew Wu each entered into a fantasy sports contest on FanDuel. Te loser of the contest Colin Dew-Becker sought to recover his bet under Te Loss Recovery Act an act which dates back to 1819 in order to to retain his money. Te 200 year old statute allows gamblers to get their money returned if the bet was placed on an illegal wager. Dew-Becker claimed that FanDuel contests are a form of gaming, and all forms of sports gambling were illegal under Illinois law at the time.

However the the court ruled, that fantasy sports are games dominated by skill, not by chance meaning that the statute cannot be applied to daily fantasy sports betting
