1 ONLINE GAMBLING (Class I licence, term – 10 years, authorisation – 1 year).


An annual licence fee (payable each year) for all types of online gambling amounts to ~ US$ 323,600.


2 LAND-BASED SPORTS BETTING (term – 10 years, authorisation – 1 year)


Annual licensing fee (payable each year) varies from ~ US$ 70,000 to ~ US$ 215,700.


3 POKER CLUB (term – 10 years, authorisation – 1 year).


Annual licensing fee (payable each year) amounts to ~ US$ 27,000.


4 LAND-BASED CASINO (term – 10 years, authorisation – 1 year).


Annual licensing fee (payable each year) amounts to ~ US$ 161,800.


5 SLOT MACHINES (term – 10 years, authorisation – 1 year).


Annual licensing fee (payable each year) amounts to ~ US$ 161,800.


Tere are also financial guarantees’ requirements, value of subscribed and paid-up share capital, mandatory contributions to the fund for prevention of the gambling addiction and etc.


KEY ADVERTISING RESTRICTIONS


• Advertising by sending unsolicited electronic messages containing information about one or more games and outdoor advertising for gambling exceeding 35sq.m in size/panel/ advertising material, are prohibited.


• Sending advertising materials to self-excluded players from online platforms is prohibited.


• Advertising of gambling services that are not authorized in Romania is prohibited.


• Outdoor advertising may not be placed within or near educational institutions, or socio-cultural/religious premises.


• Bonuses granted by online operators may be advertised only on limited channels (i.e., the operator’s own website(s), a Class II licensed affiliate’s website(s), or e- messages to active players from the operator’s database).


• It is forbidden to display, outside the gambling locations, the values or goods granted through real or simulated bonuses, promotions or jackpots.


• Advertising cannot be included in programmes aimed at minors, nor is it allowed to incite them to participate in such games.


LOCAL MARKET SPECIFICS TO CONSIDER FOR OPERATORS ENTERING THE MARKET


Overall, Romanian gambling market looks very promising for entering due to its size, volume of the market and viable advertising restrictions. To add to that, overall financial conditions applicable to potential operators seem to be rather affordable in comparison to other EU licences.


Romanian regulator is well-known as one of the deeply immersed in the market, whereas ONJN actively works with both players and operators, as well as with the state.


However, it is crucial to note that requirements to operator’s product is rather detailed and comprehensive and most of the essential third-party services (e.g., affiliates, PSPs) rendered to Romanian licensed operator should be licensed as B2B services (i.e. operator cannot use third-party service providers that do not have B2B license in Romania).


Tere were also big amendments at the end of 2023, and several ones are still on their way (i.e., new mandatory guarantee sums for licensees from 2025, or new sanctions which were adopted in April 2024).
