Look out, there’s a scam about! A reader alerted us to a situation which may be catching a number of people out.
The image to the left was taken by one of our readers who appeared to have been in breach of the terms of the parking notice. They received a letter through the post demanding payment of £60, which would double if unpaid after 14 days. The letter went on to say that they could provide a copy of photographic
evidence of the ‘offence’, for a fee of £10. And, failure to comply would result in a County Court action. The letter appeared serious and threatening.
Legal advice is, that the bills these companies send out are not bills - they are invitations to pay. People are advised not to accept the invitation to pay. Companies take photographs of vehicles’ registration numbers and issues its invoices to the registered keeper of the vehicle. They do not know who was driving it. They do not have authority to make the keeper name the driver, and they can’t sue a car. Unless somebody admits liability, maybe by writing back with an excuse, it would be very diffi cult, probably impossible, for them to successfully sue anyone. Further, their claimed action is through the County Courts, of which there are none in Scotland. Do not reply to the letter, just ignore it. You may receive further threats, but ignore them too.
There is a genuine intent of such notices to time-limit the parking, which is a sensible business measure, although there is the potential for unscrupulous fi rms to abuse this. Also, there are of course many other legal parking restrictions and controls, so check the parking notice to make sure.
