PART 7 Rule 80 ADVERTISING A boat and her crew shall comply with World Sailing Regulation 20, Advertising Code.


World Sailing Regulation 20, Advertising Code, has been subject to frequent changes in the recent past, and it is thought best not to comment in detail in case further changes make those comments wrong or redundant.


Rule 81 RESCHEDULED EVENT


When an event is rescheduled to dates different from the dates stated in the notice of race, all boats entered shall be notified. The race committee may accept new entries that meet all the entry requirements except the original deadline for entries.


By referring to an ‘event’, the rule is unclear in the context of the club situation of a single race for season’s points that does not take place for weather reasons, but which the club wishes to take place on a different date. Presumably, a free-standing race that is not part of a series would count as an ‘event’ in its own right.


Part 7 – Race Organization Rule 84


GOVERNING RULES


The organizing authority, race committee, technical committee, protest committee and other race officials shall be governed by the rules in the conduct and judging of races.


The question is what happens when this rule is not followed. In WS 66, the question was whether a race committee could change or decide not to implement the decisions of a protest committee. The background was that the race committee judged that the disqualification of a number of boats was unfair, following a measurement protest in which the class association, having been asked for a ruling as the appropriate authority, had confirmed that they had broken a class rule. The question was however worded more generally.


The answer was in the negative. ‘Rule 84 says that the race committee shall be governed by the rules. A race committee has no jurisdiction over a protest committee, and is not entitled to change or refuse to implement any decision that the protest committee may have made1


.


So who may take what action? WS 66 continues as follows: ‘In this case, the protestor and each boat protested were the parties to the hearing. Under rule 66 a party may ask that the hearing be reopened on the grounds that the protest committee made a significant error or that significant new evidence has become available. Also, under rule 70.1, a party may appeal the protest committee’s decision or its procedures.’ So a race committee that is upset by a protest committee decision must have been a party – therefore the protestor – in order for it to be allowed to request a reopening or to appeal. Even then, neither option might be successful.
