under a range of different federal laws but also under state law, whereas the regulation of all forms of gambling in Great Britain is now subject to just one national statute. Even in the realm of online sports betting, successive judgments of the European Court of Justice have restricted the EU’s influence in the gambling sphere with the consequence that gambling regulation is primarily dealt with across Europe on the basis of national rather than EU legislation.
However, I am going to mention below just a few factors relating to the licensing and regulation of sports betting in the UK that might just possibly bear consideration on both sides of the debate in the US whether to regulate or continue the prohibitions under PASPA and other federal laws.
In my view, quite regardless of the tax revenue and job creation benefits that quite obviously flow from a regulated betting sector, the following factors do show that a successful balance can be struck between the liberty of an individual to bet on sporting events as he or she wishes on the one hand and the need to prevent the evils and abuses that could arise in the absence of effective and robust regulatory controls on the other.

Since 2007, sports betting operators in the UK (including fantasy sports operators) have been licensed and regulated by one central regulator, the Gambling Commission, rather than by local courts. Te licensing of betting shops is a matter for local councils, but it is subject to strict parameters prescribed by national legislation that includes as a licensing objective the protection of children and vulnerable persons from being harmed or exploited by gambling.

Since 2007, all gambling debts (including those relating to sports betting) have been legally enforceable, although the Gambling Commission has the power to void a bet if satisfied that the bet was substantially unfair. Exercise of this power is subject to oversight by a Gambling Appeals Tribunal.
