Finally, the proposed regulatory structures in HB 3080 and SB 1963 are inconsistent with established IGB regulatory protocols and standards. Tese measures would undermine efficiency and gaming integrity objectives. Among other flaws, the legislation as drafted would impose a problematic enforcement regime that favours online gaming operators by restricting the IGB’s ability to effectively regulate internet gaming and protect Illinois patrons.


Senate Bill 2145 would require fantasy sports companies to pay a fee to operate in the state ($500,000) and place a tax of up to 40 per cent on contest receipts. Is it fair to treat fantasy sports companies like sportsbooks? With comparatively smaller margins and revenue limitations, will the tax structure effectively lock smaller operators out of the state?


Te Illinois General Assembly will ultimately determine the level of taxes and fees for the state’s fantasy sports industry. Te IGB is instead focused on the regulatory structure of SB 2145, which we view as the preferred approach to regulate fantasy sports in an effective, efficient and consistent manner in Illinois.


Another piece of legislation would create the Fantasy Sports Consumer Protection Act which would allow the Illinois Gaming Board to regulate fantasy operators. What could this look like?


Te IGB does not oppose regulation of fantasy sports operators, but we do oppose SB 1224 and the creation of the Fantasy Sports Consumer Protection Act because the legislation does not protect Illinois consumers. Instead, this proposal unnecessarily limits IGB regulatory authority, establishes a framework that favours some operators in the
