Licensed operators no longer need to be located in the Czech Republic, merely an office is enough. Basically this opens the market to international online operators.


At the moment online gambling is governed by the 202/1990 Lottery Act on lotteries and other games under which fixed odds betting is the only form of online gambling legally permitted.

gaming as customers must register in a shop before they can use the services. Technically any company offering just internet gaming is doing so illegally.


However the government never made any effort to enforce this which is reflected by huge advertising campaigns by big online operators.


Te Czech legislation was always pretty quiet on the whole online gambling law so until 2012 it was illegal even for Czech residents. In 2009 the Ministry of Finance amended the Lottery Act with Section 50 (3) which granted individual permissions for the provision of lottery games and also permitted a number of Czech betting companies the power to offer online fixed odds betting and in 2012 online gambling was added


to the Lottery Act. Te law stated that to operate lotteries or similar games the company must be a joint stock company in Czech with a registered capital of at least CzK100m (around €4m). Te Act also banned advertising.


In 2011 the Czech parliament added an amendment to the Act (300/2011) which became effective in January 2012 and proceeds used for the benefit of the public under previous legislation was replaced with a unified 20 per cent withholding tax on the Gross win and the 19 per cent corporate income tax and administration to sports betting was simplified.


Collected proceeds from taxation are divided between municipal and state budges 30:70 respectively in the case of lottery and sports betting. Te new tax law gave more power to local municipalities in terms of regulation and also allowed online casino games. It prohibited offshore operators in Czech.


In 2013 the parliament approved an additional amendment whereby a quarter of the 20 per cent withholding tax can be paid out by the operator directly to the Czech Olympic Committee. Now, from January 2016, the 20 per cent withholding tax is increased to 23 per cent for sports betting and lottery business.
