URUGUAY ONLINE New Online Proposals Come Under Fire


Representatives of the Cipriani Group have stated that online gambling rules in Uruguay are unfair and needed to be revised.


Peru - Sports betting bill’s Congress progress The bill that regulates online sports betting has now been approved unanimously by the Economy Commission in Congress. According to the latest draft, a percentage of revenue generated by sports betting will be earmarked for Peruvian sports with funds administered by the National Superintendence of Tax Administration (SUNAT).


During the debate Diana Gonzalez, the author of the project, highlighted that Peruvian sports had received less from the budget each year since 2019 and, due to the pandemic, the income that the Peruvian Sports Institute received directly -through income generated by slots and casinos had seen a sharp decline.


"For this reason, this initiative favours the promotion and financing of sports activities and our athletes," explained Gonzalez, who added that online sports betting is not currently regulated in Peru. According to government estimates, in 2018 around 1,800m soles (just over US$472m) was generated via offshore sites none of which was taxed. This bill seeks to raise more resources for the State, for the benefit of the population and, in particular, of national athletes who need more support to represent us,” said Congresswoman Gonzales.


According to the draft project: “Operating authorisations will be valid for six years, and may be renewed from six months before their expiration. Meanwhile, the Financial Intelligence Unit (UIF) of the Superintendence of Banking, Insurance and Pension Funds will be in charge of supervising sports betting activities. In addition, a guarantee amount and conditions will be established, which must be paid to cover prize payments, fines and taxes.”

Representatives of the Cipriani Group has stated that online gambling rules are unfair and need to be revised. Te Treasury Commission of the Chamber of Senators began work on the proposed changes in May, with text enabling the running of online gaming by both the State and land-based operators.


However, the Cipriani Group, which is moving ahead with the construction of its casino hotel in Punta del Este, stated that a more comprehensive proposal was necessary especially when it came to the way gambling was supervised. Cipriani's legal adviser, Pablo Monsuárez, was quoted by El País as saying that rules do not cover online games of chance in their entirety. Casino games would remain under the purview of the National Directorate of Casinos while other games would come under the control of the National Directorate of Lotteries and Pools betting. While the changes to online gambling regulation were welcome he went onto say that the proposed regulation of online games would ultimately be ‘lame’ and ‘unfair.’


“What it (the law) is going to generate is that there are players or participants in the market that have clear commercial advantages and no large infrastructures to maintain.” In addition, he insisted on the need for a comprehensive


regulation that covers the entire online gambling system, and grants equal conditions to all participating companies.


Currently online gambling is prohibited by article 244 of Law 19,535 of 2017, although online sports betting is permitted via government monopoly.


In November, Uruguay’s Executive branch sent a bill to the senate that would permit both state run and privately run casinos to offer online casino games including poker roulette and slots. Te bill, signed by President Lacalle Pou, would give the General Directorate of Casinos of the Ministry of Economy and Finance authority to run online casino games, and gives the Executive branch permission to authorise private companies that already operate casinos as well as future licence holders permission to offer online casino games.


According to reports in local press it was believed that the authorisation of online games was a key condition for the investment of the new casino in Punta del Este. In February, the Cipriani group signed the contract for a new hotel in Punta del Este. Te emblematic San Rafael hotel in Punta del Este, has been closed since 2011, but was acquired by the Cipriani Group for more than US$40m in February 2018.


Argentina Córdoba gives online gambling the go-ahead


Te province of Córdoba has passed rules that give online casinos and sports betting the greenlight. Te bidding for at least 10 permits will begin as soon as regulations are published. Both Argentine and foreign companies will be invited to take part in the tender while Te Córdoba Lottery will oversee online gaming once it is up and running.


José Alonso, Deputy Manager of the legal department of the Lottery, explained: “Te bidding process will have a term of 80 business days and on July 5 the envelopes will be opened. Te process will end in mid-September. In that month, it will be known to whom the licenses will be granted.”


In addition, he explained that the regulations are aimed at "attracting


new games or others that are already on platforms so that they can be exploited online, such as lottery games, casino games, sports betting and others. We are formalising a situation that has been developing in the province illegally, to which we are giving a framework of legality and protection for all players," he said.


An online gambling bill was put forward initially Córdoba in December. New online rules will follow similar legislation now in place in the autonomous city of Buenos Aires and the province of Buenos Aires. Online gambling is also present in Mendoza, Santa Fe, Corrientes, Chaco, Misiones, San Luis, Tucumán, Entre Ríos, La Pampa, Neuquén, Río Negro and Santa Cruz.
