GERMANY – The Regional Council of Darmstadt, the department responsible for accepting German online sports betting licence applications, has said that any company targeting German players without a licence, would face tough penalties. With the third amended State Treaty on Gambling coming into force from January 1 2020, the council has been given additional powers allowing it to take action against such offenders. The Regional Council of Darmstadt said: “The state gambling supervisory authorities will not tolerate this. Once the third amended State Treaty comes into force, sports betting providers that continue to operate in the German market without securing permission to do so can expect to be sanctioned. Therefore should no licence application be submitted to the Regional Council of Darmstadt, we will immediately prohibit the illicit offerings.” It added that the Niedersachsen Ministry of the Interior, the body responsible for payment blocking orders, would be informed so it too could take action.

News outlets having been keenly following the arrest of Yorgen Fenech, a prominent businessman in Malata, in connection with the murder of Daphne Caruana Galizia two years ago. Mr. Fenech was detained by armed officers after his yacht was intercepted and searched. Ms. Galizia, an anti-corruption blogger, was killed by a car bomb in 2017.
Mr Fenech was formerly a director of both the Maltese energy company, Electrogas and the head of the Tumas Group, of which Tumas Gaming is a subsidiary, which owns the Oracle and Portomaso Casinos in Malta, in addition to the website
portomasogaming.com. Te Tumas Group, a business consortium registered on the island is estimated to be worth over €350m and includes assets in property, gaming, hospitality, energy and shipping.

Mr. Fenech’s resignations will put a little distance between him and the businesses in question, though in most cases he remains a shareholder with family members taking up his vacant positions. In addition to the murder investigation, Malta’s Financial Intelligence Analysis Unit has linked Mr. Fenech as being the owner of Dubai-registered company, 17 Black. In a report from the Council of Europe, “17 Black had been expected to make large monthly payments to secret Panama companies owned by senior Maltese officials and had also received large sums of money from an Azerbaijani national.
Te story has evolved into a national scandal, one that had started to be uncovered by Mr. Galizia. Te investigation has resulted in multiple resignations from the government in connection with Mr. Fenech’s arrest, including the chief of staff, Keith Schembri, who was briefly arrested in relation to the investigation. Prime Minister Joseph Muscat is also stepping down as a result of the case.

Te UKGC and Spelinspektionen have signed a Memorandum of Understanding (MoU) to help build cooperation between the regulatory bodies. Te MoU supports closer communication through the sharing of best practice on areas including regulatory policies and procedures. Te agreement came into force on November 11th.
