New York has six commercial casinos (which in- cludes four casino resorts with table gaming, slots and sports betting and two landbased casinos with VLTs only) and seven racinos which offer electronic gaming devices. All are regulated by the New York State Gaming Commission. Casino gaming was authorised in 2001 via a
law which permitted slots at racetracks under the New York Lottery. In 2013 an amendment permitted up to seven commercial casinos and subsequently the state sited four destination casino resorts in different regions of upstate New York. Legislation in 2022 authorised the licensing
process for the final three casino resorts to be sited in the metropolitan area. However it is a slow process and it is thought
any decisions won’t be made until the end of this year (2025). It is rumoured two of the licences will go to existing casinos at nearby racetracks (Empire City in Yonkers and Resorts World New York City Queens) leaving one up for grabs. Tere are 11 projects so far around the city including proposals from the big casino operators. Te state appointed Gaming Facility Location Board will have the final say. Te minimum capital investment and licence fee for applicants is $500m each.

are: Rivers Casino and Resort, Del Lago Resort and Casino, Resorts World Catskills and Tioga Downs Casino. In 2023 these casinos received a total of around 6.1 million visitors. Resorts World New York City racino in Queens
was the most lucrative commercial casino outside of Nevada last year. Although it is limited to elec- tronic gaming only it had an annual gaming revenue of $942.6m last year. Commercial casino gaming revenue reached a
record $4.72bn (up 11.6 per cent) of which sports betting saw $1.70bn (up 24 per cent) with online responsible for 99.6 per cent of that. Casino games at the casinos and racinos totalled $3.02bn of which slots saw $2.82bn and table games $199.8m. Meanwhile there are around 17,600 VLTs spread
over nine facilities and there are four thoroughbred tracks and seven harness tracks. New York also has compacts with four New
York tribes to operate facilities. Tree tribes operate Class III gaming compacts – Seneca Nation of Indians, Oneida Indian Nation and St Regis Mohawk Tribe. Landbased sports betting is available at the
four casino-resorts whilst state law authorised online sports betting in 2021 with operations launched in January 2022. By the end of 2023 there were nine online sportsbook platforms op- erating. In 2023 more than $19bn was wagered in the
state via the online sports betting operators which include Bally Bet, Bet MGM, Caesars, DraftKings, FanDuel, Points Bet, Resorts World Bet, Rush Street and Wynn. FanDuel saw the biggest GGR in 2023 followed by DraftKings. New regulations governing advertising in sports
betting were introduced in October 2023 which prohibited marketing on college and university campuses or via media with a young audience. Operators were also required to avoid certain terms in advertising and promotional campaigns.
