license, otherwise ~ US$ 13,600. As for the gambling supervision fee, it stands at the rate of 2.5% of the quarterly NGR but no less than approx. ~ US$ 15 and no more ~ US$ 13,600.


3) Online sports betting license (term is defined on a case-by-case basis with max. of 7 years)


For online sports betting license an administrative service fee in amount of ~ US$ 27,200 must be paid for the licensing procedure. Tere is also a gambling supervision fee of 2.5% of the quarterly NGR, but at least ~ US$ 272 and ~ US$ 27,200 maximum.


Once the operator receives confirmation on license approval, it should pay the full license fee at once in the amount of ~ US$ 1,632,000.


4) Card rooms license (term is defined on a case-by-case basis)


For card room license an administration and service fee in amount of ~ US$ 50 per card table. In addition, there is a gambling supervision fee at the rate of 5,000 of the quarterly NGR, but at least ~ US$ 15 and ~ US$ 2,720 at the most.


5) Land-based lottery license (term – 5 years)


For lottery license an administrative and service fee in amount of 0.5% of the prize fund specified in the game plan, up to a maximum of ~ US$ 27,200 for other type of lotteries’ license.


ADVERTISING RESTRICTIONS


Only operators that hold a Hungarian license can advertise gambling services, and advertising may only be published if the advertiser has provided the SARA’s authorisation for the operation of gambling and other data.

no gambling advertisement may be published that is addressed to children and minors or encourages minors and children to participate in gambling;


u


no gambling advertisement may be published in any printed media primarily for children and/or minors;


u


no gambling advertisement may be published related to gambling without the license; and


u


it is prohibited to play a role in any advertisement that is connected to unauthorised gambling operated in Hungary.


LOCAL MARKET SPECIFICS


Most of the Hungarian regulated gambling verticals are covered by the state monopoly, which is outlined as a possibility to receive the license only for a state-owned entity (sports betting) or through concession contracts (casinos and lotteries).


Tough, even if concession contracts in words can be granted through public tender to every interested operator, they are granted through mainly private tenders for “reliable operators”, whose definition is quite narrow.


Tus, the concessions of the current 11 land-based casino licenses were all obtained by reliable operators through a concession contract concluded directly with the competent Minister, meaning that no public tendering was conducted.


Tese strict regulations make it very hard for new operators to enter the land- based Hungarian market legally. Te situation with card games and online betting licenses is more open, whereas every interested operator from EEA can obtain an applicable license through a general application procedure.


Tere could be some difficulties with the requirement for online betting applicants (or their affiliates) for at least five years of experience in online gambling operations in order to be granted a license.


But such experience may be gained in remote gambling or online casino games in an EEA state and the relevant authorisation must have been issued by the competent authority of the same EEA state.


Te gambling industry in Hungary is stable and well-regulated; however, there is significant potential for further market growth. As Hungary shares borders with several countries that have established strong regulatory frameworks for gambling, such as Romania, Serbia, and Ukraine, it is hoped that the country will adopt best practices to enhance its own legislative framework.
