HMRC seeks to impose free-bets tax changes in Finance Bill 2017

UK

Te UK’s Revenue and Customs department, the HMRC, plans to implement new rules related to free bets, discounted betting and freeplays in the forthcoming Finance Bill 2017. Te changes in tax legislation are expected to come into effect from accounting periods starting August 1, 2017.

Te changes would see gambling operators required to account for duty when a customer places a free bet or a reduced-rate bet. Te duty is to be calculated on the amount of money that would have been paid by the customer in circumstances in which the special free bet or reduced-rate

bet offer has not been active.

HMRC is also redefining and amending what constitutes as a ‘prize.’ Te change will ensure that in future operators cannot use the value of free- plays granted to customers as prizes in order to reduce the profit that’s subject to duty payments.

Te amendments will apply not only to land-based gambling operators, but also to the ones who have their operations offered on the Internet, by television, radio, telephone as well as any other electronic communication and are subject to remote gaming duty.

Te HMRC estimates an additional £45m will be raised by the tax changes expected over the 2017/2018 fiscal year and £110m by the fiscal 2020/2021.
