Te Office of the Comptroller General of Chile has issued a statement clarifying the procedure for the municipal governments when it comes to defining when machines should be classed as gambling machines in so called ‘neighbourhood casinos.’
Te new guidelines indicate that the municipalities should ask those interested in obtaining permission to operate electronic gaming machines, to obtain a report from the gambling Control Board (SJC) stating that prizes are not handed out randomly by the electronic machines on their premises.
Te new rules give the SJC the right to determine what constitutes random and what constitutes entertainment machines and state that only certifications issued by gaming laboratories approved by the SJC will have the capacity to verify conclusively if a machine is either a gambling machine or if the result depends on an element of skill. Te new ruling issued by the Comptroller General was issued at the request of the SJC, and in the case that the body establishes that the result of the machine in question depends on chance, then the municipality will not be permitted to grant the machine permission to operate. New law would continue casinos on cruise ships
Carlos Camaño the Director of National Hydrography in Uruguay, a government department that oversees port activity and maintains and develops local waterways, released a statement that a bill is now being prepared that would allow for casinos in cruise ships to remain open when they arrive in both the ports of Montevideo and the Atlantic resort of Punta del Este. Te new law, if approved, will also allow cruise ships to remain longer and will, as a result, increase tourist spend in Uruguay.
Te closing of casinos in cruise ships while docked in Uruguayan harbours is one of the reasons why they have in the past only stayed for a few hours in Uruguay, according to the government official.
Te new law would encourage passengers to spend more in Uruguay and also encourage visitors to explore Uruguay more extensively. Minister of Tourism Liliam Kechichian, confirmed: “Tis is a proposal that cruise companies have been putting forward for some time. As a counterpoint we are going to request that ships spend more time in Uruguay: at least one night. Tat extends the area of work and business around a product that is growing a lot," she said.
Data provided by the Ministry of Tourism show that during the 2015-2016 cruise ship season, 196,000 passengers and crew arrived in Montevideo while 121,000 arrived in Punta del Este. Spending in Montevideo stood at US$7.6m, while it contributed US$3.5m in Punta del Este. Meanwhile, spend per person in Montevideo stood at US$38.9 and in Punta del Este US$29.

Te decision comes after the SJC released the results of its first ever survey into gaming machines operating outside of casinos in July. Te wide ranging study, which was carried out on behalf of the SJC by the Faculty of Architecture, Design and Urban Studies at Te Pontifical Catholic University of Chile, revealed that there are now more than 33 thousand machines operating illegally in Chile. Te results of the study were delivered to the 88 respective municipalities where these machines were found to be operating so that appropriate measures could be taken to prevent the growth of illegal gambling.
According to Chilean gaming law of 1995, slots outside of casinos are strictly prohibited. Te law states that slot machines may only be operated in the seven municipal casinos as well as the other privately run casinos throughout the nation. Furthermore, Te SJC has exclusive powers to award, reject, renew and revoke operating permits for casinos in the country and licenses for gambling and associated services.
Mexico/Chile
Mexico’s new gaming law currently under consideration could possibly allow casinos on cruise ships. Under current rules it is illegal for casinos on cruise ships to open their doors to their passengers while either docked in Mexican ports or while sailing in Mexican waters unless they are given permission in advance by the Interior Ministry. Meanwhile, Chile changed its laws in 2011 after the number of cruise ships arriving in Chile had reduced significantly after the 2005 Casinos Act, which required that all cruise ships had to close their casinos when they passed within 13.8 miles of Chile’s shoreline. After laws were changed the number of cruise ships arriving in Chile reached the highest levels in seven years in 2016.
