In October 2023 the National Association of Professional Football (ANFP) was ordered to cut ties with sports betting


operators after Chile’s highest court accepted an appeal from state owned lottery company Polla Chilena de Beneficencia


(Polla) and ordered the blocking of online betting platforms - a decision that was welcomed by the Gambling board (SCJ) and later backed by Chile’s telecom regulator Subtel.


Firstly any operator who has been present in the market will


be absent for the first year due to a mandatory cooling off period. Tis is because those companies that have been present in the market 36 months prior to the law coming into effect will not be able to apply for licenses until 12 months have elapsed. Meanwhile a process for granting temporary licenses will be established for applicants who have not offered online gambling in Chile in the past 12 months. Similar to casinos, operating companies must meet a series of formal requirements which have in turn been strengthened by the new bill. Polla will get a quick start out of the gate as it has a legal


license that allows it to immediately start operating sports betting activities without the need for further administrative approvals once the bill is passed. Additionally, both Polla and the Concepción Lottery will be able to broaden their range of activities and apply for general licenses that will permit them to engage in a wider variety of betting and gambling related operations. Lawyer Carlos Baeza, advisor to Betsson, Betano,


BetWarrior, Coolbet, Latamwin and 1XBET welcomed the passage of the bill in the lower house but has been critical of the tax rate which he said would amount to 38 per cent. Baeza also reiterated his concerns over the so called “cooling off” period which he said would benefit land based casinos and the lottery sector and threatened competition in the market. As the senate has still yet to vote on the new bill legal


manoeuvres on the part of Polla and the Concepción Lottery continue. In May Polla filed five lawsuits against Chile’s largest internet providers Entel, Telefónica, WOM, GTD Manquehue and ClaroVTR because they have failed to block access online sports betting sites. In August the Supreme Court of Santiago declared admissible an appeal filed by Lotería de Concepción, which accused various telecommunications companies of failing to block access to illegal gambling and casino websites in the country.


PERU


Te Ministry of Foreign Trade and Tourism (Mincetur) approved the regulations of Law No. 31557 which regulates online gaming and sports betting in October 2023. Law 31557 was signed by then President of Peru Pedro Castillo in August 2022 putting the newly regulated industry under Mincetur. However, Law 31557 in its previous form had come under criticism as it only would have applied to those operators with a physical presence in Peru. Tis meant that locally based operators would be at an unfair advantage once the online gambling bill went into effect. As a result lawmakers went about improving the bill. Law


No. 31806, (which modifies Law No. 31557 on online gaming and sports betting) was enacted in the Official Gazette of Peru, after obtaining the signature of President Dina Boluarte in July 2023. All companies whether national or foreign, must adapt to the new regulation and comply with the correct payment of the special gaming tax, which has been applicable since April 2024. Te tax stands at 12 per cent of the net profit. In February 2024 the window for companies interested in
