with operators arguing its unconstitutionality in court. Te NLRC sparked further controversy in 2022 by expressing its intention to grant offshore licenses to overseas-based companies without them having a physical presence in Nigeria, allowing them to offer online gambling services in the country.
FEDERAL REGULATION Te NLRC was established through the National Lottery Act of 2005. Te Commission was primarily born out of the need to regulate the operations of lottery business, promote transparency and accountability and protect the interests of players, stakeholders and the general public. Te commission also took up the re- sponsibility of issuing licenses, monitoring gambling activities, and enforcing compliance with regulations. Tere are a number of different classes of licence granted by the NLRC namely:
u Lottery Licence
u Sports Betting Permit u Mobile Lottery/Gaming u Promotional Lottery (CSPs) u Casino Gaming Permit (CGPs)
Lottery license Te licence has a duration of 10 years. License fee costs N100,000,000.00 (One Hundred Million Naira). It allows the operator to offer both retail and online lottery games. Te ap- plicant’s company must have N50,000,000.00 (50 million Naira) paid-up capital.
Sports betting A sports betting licence is valid for five years. Te applicant’s company must have a minimum share capital of N30,000,000.00 (30 Million Naira). Te licence fee stands at N100,000,000.00 (100 Million Naira). Both retail and online sports betting is permitted. Live betting, sportsbook, virtual games and others types of sports betting games are allowed. Permit holders are required to pay three per cent gross turnover on monthly sales to the National Lottery Regulatory Commission (one per cent) and National Lottery Trust Fund (two per cent).
Mobile lottery/gaming Tese are classified as schemes with the elements of chance offered to the general public using mobile/telecommunication channels including SMS, USSD, Mobile Apps and any other telecoms-enabled channels. License duration is for one year. Te applicant company must have a minimum share capital of N30,000,000.00 and show evidence of domain name registration with (ng/.com) Permit fee of N5,000,000 per annum. Payment of five per cent monthly gross proceeds.
