BRAZIL LEGISLATION First Online Licences Announced in July


Brazil’s Treasury is opening a registration window for sports betting and online gaming licences with results set to be published in July.


Uruguay - Approval for new Carmelo casino The specifications and the call for tender for the Carmelo Hotel Casino have been approved. The terms and conditions for the tender of the hotel, which is owned by the State, were developed by a commission composed of the Ministries of Tourism and Economy, the Office of Planning and Budget, the National Ports Administration, and the Departmental Government.


Currently, the property is in a dilapidated state. The specifications require that a project be submitted which includes a hotel with a convention hall for 500 people, an events and entertainment hall, a restaurant offering international and local cuisine, a heated swimming pool, over 100 rooms, a 200- meter dock for small boats, and the tender also grants a license to operate a private casino.


Through his X account, Mario Colman, deputy for Colonia, declared: "We have just been informed by the Presidency of the Republic that the specifications and the call for tender for the Carmelo Hotel Casino have been approved”, adding that this is "very good news for Carmelo." Located in the Uruguayan city of Carmelo, the term of the Hotel Casino Carmelo licence ended on June 30 and closed in July 2020.


Peru - Online registration window opens The window for companies interested in operating online sports betting and casino games in Peru has opened. Companies offering online gaming and sports betting services had to submit their application for authorisation to operate online under the terms of Law No. 31557 and have until March 13 to register.


Minister of Foreign Trade and Tourism (Mincetur) Juan Carlos Mathews, stated that the implementation of this law, along with new regulations will have a major impact on the industry and for bettors. "Most importantly, it will provide security for the bettor, promote responsible gaming, and formalise the activity," Mr. Mathews said. “115 companies have been identified as offering remote gaming and sports betting services in the country, of which 86 are non- domiciled and 29 are Peruvian.”


In the case of non compliance operators risk being sanctioned and reported and could in some instances face criminal charges. The law will begin to be enforced on April 1. The law regulating the exploitation of remote gaming and sports betting stipulates that the Ministry of Foreign Trade and Tourism is the national administrative authority responsible for regulating, authorising, revoking, overseeing, online gaming and sports betting. All companies must adapt to the new regulation and comply with the correct payment of the special gaming tax - standing at 12 per cent of net profits.

Speaking at last month's ICE VOX conference in London, Special Advisor to the Ministry of Finance José Francisco Manssur said that Te Treasury intends to open a registration window in March for sports betting and online gaming licences in Brazil and in July would publish the first official list of companies authorised to operate in Brazil. A second window to add more companies would be opened from October to December, he said.


According to a Ministry of Finance press release, Brazil has now passed an effective betting law and is working on putting in place further regulations in place to make the legislation effective. “At ICE London 2024, Brazil has a betting law and is working on regulating this legislation,” said Manssur.


Speaking during the Ordem e Progresso? Analysing the New Regulatory Environment for Gaming in Brazil panel, Manssur stated that the government was expected to move forward with the enactment of at least 12 ordinances to


regulate online gambling.One of the ordinances will deal with certification laboratories, which will be responsible for analysing the conformity of platforms, software and hardware used by the sector. Another ordinance will focus on advertising and advertising actions specific to the segment. Tere will also be an ordinance specifying the opening and closing date of the first window for forwarding authorisation requests.


Manssur emphasised that the goal is to establish a healthy market for all agents. From the gamblers' point of view, the intention is to avoid compulsive gambling and exposing the public to fraud. Argentina Coalition wants advertising ban in Córdoba


Lawmakers from the province of Córdoba belonging to coalition Juntos por el Cambio (Together for Change) have presented a bill proposing the prohibition of online gambling advertising and sponsorships in the province. Tey also want to implement a biometric data registry to prevent minors from accessing online gambling.


Te bill proposes several modifications to Law 10.793, which regulates online gambling. Among these, certain modifications targets Article 20, concerning the advertising and promotion of gambling activities.


"Te advertising, sponsorship, or promotion, under any modality, of gambling activities included in this law, even if they have prior authorisations from the Lottery [of Córdoba] to appear in advertising media, is prohibited," the bill states. Te bill also proposes carrying out prevention campaigns warning against the


harm of compulsive gambling, as well as the implementation of workshops and awareness sessions in educational institutions in the province.


Te text also includes a modification regarding the fee obtained from granted online gambling licenses, directing half towards implementing “Programs for the Prevention of Gambling Addiction” and training on responsible gambling in schools, with the other half going towards financing social programmes.


Provincial legislator Alejandra Ferrero warned that the participation of minors "has been increasing on virtual gaming platforms" and that, in response, the project seeks to incorporate a biometric data registry. Te legislators went on to say that: “Te brutal growth of online gambling in Argentina and especially in the Province of Córdoba, worries mothers, fathers, teachers and specialists.”
