SPONSORS OF LEGAL EAGLES

BOTTLE NECK This would not be to advocate any less robust a review of applications, but would ensure they are reviewed by appropriate specialists and would avoid wind applications and any other planning application becoming bottle-necked in the same queue.

CONTINENTAL EDGE our European neighbours are trailblazers in renewable energy use. In Germany, planning law restrictions are reduced as incentives are increased. Japan’s Fukushima nuclear disaster encouraged the German government to take action. It has upped the pace at which it is phasing out nuclear energy in favour of renewable power.

GERMANY The process of closing power plants, named Energiewende, led to the closure of eight plants last year. The glaring effect of this activity is that wind turbine suppliers with bases on the continent have a growing market in their back yard and have less reason to ship to the UK.

The German renewables market is mature and developed. The country is a major player in renewable energy, ranking in third place after only China and the USA. A healthy number of large renewable energy firms have operations there, with the focus on future growth.

SPAIN For the first time ever, Spanish wind farms produced more electricity during the last three months than any other variant form of power source. over six terawatt hours of electricity was delivered in January according to the Spanish Wind Energy Association,

Red Electrica de Espana. these results indicate the Spanish government is following through on its ambitions to reduce carbon emissions by boosting wind power.

the UK can emulate the success of the likes of Germany and Spain lessening loopholes in the application process and increasing funding available.

WIND OF CHANGE planning hold-ups are hampering the UK from becoming a centre for renewables excellence.

trade body RenewableUK indicated more applications for onshore turbines are being

passed by local authorities. While this is a hugely positive development, there is room for improvement.

The country is blessed with a wealth of natural resources which must be utilised to our advantage. In order to convert our renewable capability into energy, local and national authorities should lessen the administrative burden for applicants to ensure the UK does not miss out on a unique opportunity to change the energy landscape.

HELPFUL ILLUSTRATION

This case is a helpful illustration of the fact that the court, even when faced with a change of position by the Secretary of State at a late stage of the proceedings, will focus on the merits of the arguments put to it. Hopefully this will provide some comfort to anyone faced with a similar set of circumstances in the future.
