MEXICO – Decreto limita a 15 años el permiso para una operación de casinos
“ARTÍCULO 33. ... I. Los permisos para la apertura y operación del cruce de apuestas en hipódromos, galgódromos, frontones, centros de apuestas remotas y salas de sorteos de números o símbolos tendrán una vigencia mínima de un año y máxima de 15 años;” De esta forma se modifi ca el periodo de autorización para las operaciones de juegos de azar y apuestas en México, tal como dispone el Decreto presidencial “por el que se reforman, adicionan y derogan diversas disposiciones del Reglamento de la Ley Federal de Juegos y Sorteos”. Publicado el 16 de noviembre, en el Diario de la Federación de México, y fi rmado por Andrés Manuel López Obrador, Presidente de los Estados Unidos Mexicanos, “en ejercicio de la facultad que me confi ere el artículo 89, fracción I, de la Constitución Política de los Estados Unidos Mexicanos, además de otras drásticas medidas contra el comercio de juegos y sorteos en México. Efectivamente, quienes decidan invertir en el sector del juego mexicano deberán aceptar las limitaciones del decreto presidencial, que establece un periodo único de 15 años, si prórroga alguna, afectando también los permisos de los actuales operadores, como indica el segundo párrafo en “Transitorios”, Segundo: Asimismo, el primer párrafo de Segundo en Transitorios cierra la posibilidad de nuevos negocios en el sector: “SEGUNDO. A partir de la entrada en vigor del presente Decreto, no se otorgarán nuevos permisos para la apertura de establecimientos diversos a las hipótesis previstas en el presente reglamento”. Y para rematar, no habrá prorrogas a los permisos ya otorgados, es
decir: las salas de juego en operación, “continuarán surtiendo sus efectos hasta la conclusión de la vigencia de los permisos que originaron, sin incluir sus prórrogas”. Sin embargo, la mejor parte del decreto es que se cancelan, “las autorizaciones de las personas operadoras que no se encuentren explotando o administrando un establecimiento en funcionamiento a la entrada en vigor del presente Decreto”. Con esta norma parece terminar el abuso del reglamento aprobado en 2004, cuando el entonces Secretario de Gobernación, Santiago Creel, otorgó más de 100 permisos a una subsidiaria de Televisa, Según reportes de ese tiempo, los permisos a Televisa fueron por intenciones de contar con soporte mediático para campañas políticas. La intención del gobierno de AMLO es de reducir los negocios de juegos de azar en el país, donde previamente se había cuestionado la legalidad de las máquinas tragamonedas, las cuales fueron declaradas legales siempre y cuando operen en una sala de apuestas y sorteos - casinos, en 2016, por la Suprema Corte de Justicia de la Nación.

“ARTICLE 33. ... I. Permits for opening and operation of bets at racetracks, greyhound tracks, frontons, remote betting centres and lotto draws salons (slots locations) shall be valid for a minimum of one year and a maximum of 15 years;” In this way, the authorization period for gambling and betting operations in Mexico is modifi ed, as provided for in the Presidential Decree, “through which various provisions in the Regulations of the Federal Law on Games and Sweepstakes are reformed, added and repealed.”
Published on November 16, in Mexico’s Offi cial Gazette and signed by Andrés Manuel López Obrador (AMLO), President of the United States of Mexico, “in exercise of the power conferred on me by Article 89, section I, of the Political Constitution of the United Mexican States,” plus other legal articles, the decree includes other drastic measures against the gaming sector in the country. Indeed, now whoever decides to invest in the Mexican gaming sector must accept the limitations of the presidential decree, which establishes a single period of 15 years, without any extension. This also affects permits held by current operators, as indicated in the second paragraph in “Transitorio”, Second. Likewise, the fi rst paragraph of Second in “Transitorio” closes the possibility of new gaming businesses in the sector: “SECOND. From the date when this Decree comes into effect, no new permits will be granted for the opening of establishments other than those provided for within these regulations.” And to top it off, there will be no extensions to the permits already granted, that is, gaming operations, “will continue to offer their services until the end of the validity of the permits they were granted, not including any extensions.” The best part of the decree, however, is that it cancels “all authorizations of operators who are not operating or managing an establishment at the entry into force of this Decree.” This provision seems to end the abuse of the regulations approved in
2004, when the then Secretary of the Interior - locally known as the Segob - Santiago Creel, granted more than 100 permits to a subsidiary of giant TV company Televisa. According to reports from that time, the permits to Televisa were granted with the intention of having media support for future political campaigns. The intention of AMLO’s government is to reduce gambling businesses in the country, where the legality of slot machines had previously been questioned, but which were declared legal by Mexico’s Supreme Court in 2016, as long as they operate under a Segob permit in a casino.
