BRASIL 134 operadores listos para licencias de “bets” y juego online
El 27 de octubre del año pasado, el Ministerio de Hacienda emitió la Ordenanza Normativa MF N° 1330/2023 en la que otorgó un plazo de 30 días para que las empresas interesadas en solicitar autorización para apuestas deportivas, llamadas localmente, “bets”, en el territorio nacional presentaran una manifestación de interés previa no vinculante, acompañada de la documentación correspondiente. Durante dicho período, 134 empresas presentaron una manifestación de interés previa, y a juicio de José Francisco Manssur, asesor especial de la Secretaría Ejecutiva del Ministerio de Hacienda, este importante número de solicitudes “representa el resultado de un diálogo constante entre el Ministerio de Hacienda y todos los segmentos de este mercado, en la construcción de una regulación segura y confiable para todos los involucrados”, por lo cual tales empresas tendrían prioridad en obtener la debida autorización. Tales empresas tendrán prioridad en las solicitudes de autorización, tan pronto como se abra el plazo de recepción de las solicitudes de subvención y pagos. Cabe aclarar que esta lista de empresas interesadas no es definitiva, ya que el cierre de la manifestación de interés no significa que otras queden fuera del mercado. Varias empresas prefirieron esperar la aprobación final de la ley por parte del Congreso para saber, por ejemplo, si se incluirían o no los casinos online, para luego decidir solicitar una licencia. Por lo cual, tanto las 134 empresas que hayan presentado su documentación, mientras que las nuevas que se sumaron posteriormente y las que se incorporen a partir de ahora, también permanecerán en el análisis del Ministerio de Hacienda para el otorgamiento de una licencia. La expectativa del gobierno es utilizar la regulación de las apuestas como una forma de impulsar el objetivo de reducir a cero el déficit en las cuentas públicas a partide del año en curso.

On October 27 of last year, the Ministry of Finance issued Regulatory Ordinance MF No. 1330/2023 granting a 30-day period for companies interested in requesting authorization priority in sports betting operations in the national territory, to submit a prior non-binding expression of interest accompanied by the corresponding documentation. During this period, 134 companies submitted a prior expression of interest, and in the opinion of José Francisco Manssur, special advisor to the Executive Secretariat of the Ministry of Finance, this significant number of applications “represents the result of constant dialogue between the Ministry of Finance and all segments of the betting market in the construction of a safe and reliable regulation for all those involved.” Therefore, such companies would have priority in obtaining the proper operations authorization. As stated, such companies will have priority in
applications for authorisation as soon as the period for receipt of
applications for licensing and payment opens. It should be clarified that this list of
interested companies is not final, as the closure of the
expression of interest
does not mean that others have been left out of the market. Several companies preferred to wait for the final approval of the law by Congress to know, for example, whether or not online casinos would be included, and only then make a decision to apply for a license. The regulation for fixed-odds lottery – sports betting - activity in Brazil is a system that includes online gambling, virtual online gaming events, and real sports-themed events, such as soccer and volleyball matches, for example. In this mode, the bettor will win if they match any game condition or the result of the match that they bet on. On December 30, 2023, President Lula sanctioned the
law that regulates sports betting, including the text that also authorizes the operation of online casinos. The government’s expectation is to use the regulation of gambling to boost the goal of reducing the deficit in the public accounts to zero from the current year onwards.
