A new bill put forward by Deputy Eduardo Bismarck would allow for an expanse of gambling nationwide. PL 5319/2019 seeks to amend the Criminal Offenses Act, to authorize gambling in leisure resorts and hotels authorized by the Federal Executive Branch.


Under Brazilian law any game involving a bet is a crime according the Criminal Contravention Act of 1941. As this law still stands, any type of gaming activity that does not have its own regulations is considered to come under the Act.


Te text presented by Congressman directly changes the text of article 50 and would lift the gambling ban for "leisure resorts and casino hotels authorized by a regulatory body designated by the Federal Executive Power."


In his justification for changes to the law the Deputy argues that gambling in Brazil is widely practiced, and the fact that it is illegal does not prevent the activity from occurring. As a result Brazilians would have a safe regulated space in order to gamble if current rules were changed.


In addition regulating the industry would be beneficial to society as it would raise much needed income for the government.


Te bill now awaits the order of the President of the Chamber of Deputies, Rodrigo Maia. It may either be voted on in a plenary session or referred for discussion in other house committees.


It is not the first attempt to legalise gambling by changing the 1941 Act. Proposed changes to the law were submitted to the Federal Supreme Court by the Partido Humanista da Solidariedade (Humanist Party of Solidarity) in January and aim to nullify laws which make the private operation of gambling illegal.


According to a PHS party statement at the time, gaming laws as enshrined by Article 50 of the Misdemeanour Law or Criminal Contravention Act and decree Law No 9215 of 1946 (which cover morality and good customs), go against the fundamental right of equality provided for in article 5 of the Federal Constitution.


Mexico Deputy Puts Forward Proposals for Added Taxes


Deputy of governing party National Regeneration Movement (Morena), Emmanuel Reyes Carmona, has put forward an initiative that would impose a 20 per cent Special Excise Tax on Production and Services (IEPS) on online gambling.


Te IEPS tax is imposed on certain products which are deemed harmful in some way to the population or environment such as soft drinks, cigarettes, alcohol and petrol and is already imposed on casinos for which it stands at 30 per cent. Te deputy included the initiative in the Parliamentary Gazette for presentation at the Assembly.


"Te point is that we live in an economic market where online betting is growing every day, and they still do not have any concise regulation in this regard," said the deputy. "In this form of betting there are still many tax loopholes, and they remain a tax haven for online casinos and sports betting houses," the lawmaker stated in


the explanatory statement for the new bill. Te initiative needs to be analysed in the committee stage before it can to be elevated for parliamentary discussion in the plenary.


Lawmakers from the party are already looking to increase taxes on gambling. In June Senators belonging to the Morena party announced that they will put forward an initiative to increase taxes on gambling and change online gambling rules.


Te new taxes would also be in the form of an increase in the tax rate of the Special IEPS tax.


In addition the party is seeking to put in place a new set of taxes and regulations when it comes to the online industry which will include a number of player protection measures. New regulations are needed due the growing popularity of online gambling which need to be brought in line with international standards the party said.


Uruguay


According to a report released by the Directorate General of Casinos state run casinos in Uruguay generated US$640m in the last ten years. Te report covering the period 2009-2018 stated that a total of US$82m was invested in slot machines, technology, equipment and refurbishments and improvements to gambling facilities. Te average profitability for the casinos in the period stood at 30 per cent. Te analysis shows that in 2009 the General Directorate of Casinos had 1,129 employees while in 2019, this had decreased slightly to 1,035 workers. Meanwhile the number of establishments increased while services provided by the central office improved. Te Directorate stated that all establishments in the country are now connected in real time online. In Uruguay there is no cap on the number of casinos nor is there a limit on how large they can be.
