PERU LEGISLATION High interest for Peruvian Market


145 authorisation requests have been submitted by national and international companies to participate in Peru’s online gambling industry.


Argentina - Curbs to online licences in Córdoba Right wing conservative party Encuentro Vecinal Córdoba has announced that it will propose two bills next month that will limit the "actions of online gambling that are exploited" in the province. In a statement, the party clarified that they are looking to prohibit the granting of new online gambling licences, prohibit the creation of new modalities of gambling and create a commission of experts to evaluate the termination of existing contracts regulated by Law 10.793.


They also made it clear that they will demand the consideration of the bill presented by coalition Juntos por el Cambio (Together for Change). In February lawmakers from the province of Córdoba belonging to the coalition presented a bill proposing the prohibition of online gambling advertising and sponsorships in the province.


If approved, the bill would also implement a biometric data registry to prevent minors from accessing online gambling. Provincial legislator Alejandra Ferrero warned that the participation of minors “has been increasing on virtual gaming platforms” and that, in response, the project seeks to incorporate a biometric data registry.


Argentina – Impetus for Atlantic coast casino Mayor of the city of Necochea Arturo Rojas announced that he would be travelling to the capital city of Buenos Aires province La Plata with the aim of meeting with the president of the Provincial Institute of Lotteries and Casinos (IPLyC) Gonzalo Atanasof. Rojas said that he would try to obtain a permit for slot machines for the Necochea casino.


The announcement comes after Governor Axel Kicillof paid a visit to the district last week. Aware that the lack of a permit has become a hindrance to the arrival of private companies the governor said that the government intended to invest in the Casino Complex - one of the most iconic locations on the Atlantic Coast. The Mayor called upon workers in the sector to formulate a unified request to bolster his presentation to the IPLyC. As a result he received Paulo Cesar Nielsen from the Casino Employees Association (Asociación de Empleados de Casino) as well as Fernando Hansen and Valeria López, representatives of the Casino Administration, Maintenance, and Service Union (Gremio de Administración, Maestranza y Servicios de Casino)..


The Mayor said: “The most important request is for it to be tendered alone. We are in a context where the other venues are operating with slot machines under an extended tender, which makes no sense to do in Necochea because we don't have the machines. What we urgently need is a tender to bring back the slot machines."

During the first 30 days of the enforcement of Law No. 31557, which regulates the operation of online gaming and sports betting in Peru, 145 authorisation requests were submitted by both national and international companies to participate in online gambling.


Additionally, 144 affiliated service providers were registered, and seven international certification laboratories were accredited. Tese providers have submitted 184 requests for the homologation of technological platforms, gaming programmes, progressive systems, and gaming modalities.


"Tese companies have submitted their requests to formalise and obtain the corresponding authorisation to continue operating in Peru, a clear indication that the regulation of this activity has been successful," said Minister of Foreign Trade and Tourism (Mincetur) Juan Carlos Mathews in a statement.


Mincetur hopes that the enforcement of Law


No. 31557 and its regulations will provide security to players through responsible gaming policies, as well as formalise the activity. It is estimated that the volume of bets placed in Peru during 2022 was close to S/3.800bn.


"Tis is an important step taken by Peru to regulate this activity, not only due to the economic movement it generates and the revenue it will collect but also due to the need to provide security to citizens who access and use these applications," Mathews said.


Te window for companies interested in operating online sports betting and casino games in Peru opened in February. Companies offering online gaming and sports betting services had to submit their application for authorisation to operate online under the terms of Law No. 31557 and were given until March 13 to register. Mathews stated at the time that the implementation of this law, along with new regulations would have amajor impact on the industry and for bettors.


Brazil Loterj authorises four nationwide platforms


Te Rio de Janeiro State Lottery – (Loterj) has authorised four online betting platforms to operate across Brazil, sparking controversy within the Ministry of Finance, which according to newspaper “Folha de S.Paulo" is reportedly considering legal action against the decision.


Crucially, Rio de Janeiro has not imposed any geographical restrictions on these licensed sites, enabling them to operate nationwide. Since November last year, Loterj had been involved in a class action lawsuit regarding the criteria it established for allowing companies to operate in the state.


Now, the Paraná State Lottery (Lottopar) has filed a petition to be accepted as part of that same action in the State Court of Rio de Janeiro. Lottopar wants to halt Loterj's bidding process alleging that Loterj is circumventing Brazil’s sports betting laws. Loterj has granted four licences: Apostau.com,


Bestbet, Marjosports, and PixBet, while 1xBet, Lema, and Laguna are the process of obtaining licences.


In the lawsuit, Lottopar pointed out that Article 35-A of Law 14,790, which regulates sports betting in Brazil, authorizes States and the Federal District to exploit, within their territories, only the lottery modalities provided for in federal legislation.


However, Loterj has defended its actions. "Loterj maintains dialogue with all spheres of the public and private sectors, as well as oversight bodies, valuing a federative and democratic environment," said the Rio lottery in a statement.


In February, local press reported that while the Federal Government has yet to finalise regulations for the online betting market, Rio de Janeiro and Paraná were attempting to take pre-emptive measures by adopting initiatives aimed at increasing revenue.
