Law firm fires warning after Rolls-Royce case
A business crime expert from law firm FBC Manby Bowdler has warned companies cannot buy their way out of trouble when facing prosecution, following a high-profile case involving car giant Rolls-Royce. The firm was offered a Deferred
Prosecution Agreement (DPA) earlier this year after facing allegations that it supported bribery and corruption over a 24-year period. The company struck an agreement
with the Serious Fraud Office (SFO), which allowed it to pay fines in excess of £497m to settle the claims, which allowed it to avoid prosecution. Elisabeth Glover of Manby Bowdler’s specialist
regulatory and business crime team says companies should think twice about relying on money to wriggle out of legal cases. She said: “With an associated price tag amounting to £497m in UK fines and charges,
any company thinking that the Rolls-Royce case is one to be copied would do well to first do their homework. “Simply, DPAs are not raffle tickets that the SFO hands out lightly. In making its decision to take this course of action, it will have considered what was in the best interests of justice, how co- operative the company was; the steps being taken to ensure future
compliance through changes to the corporate culture and leadership, and what other implications, including those of cost, bringing a prosecution could lead to. “While Rolls-Royce found itself facing these
charges due to likely malpractice over several decades, its co-operation, willingness to self- investigate and the introduction of radical improvements (not to mention significant financial penalties) were what ultimately saved it from its likely demise.”
Double honours
for chairman Asian Business Chamber of Commerce chairman Nasir Awan has been handed two significant honours. Mr Awan was appointed Deputy
Lieutenant of the West Midlands by Lord Lieutenant John Crabtree at a dinner at Birmingham City University. He is also among 12 people to be
awarded honorary degrees by Aston University. Mr Awan said: "I am honoured to be
appointed a Deputy Lieutenant for the West Midlands and look forward to supporting the Her Majesty’s Lord Lieutenant, in particular his task of increasing the number of honours and Queen's Awards for enterprise to the region, which is well behind in proportion to the industry and population of the West Midlands. Mr Awan was president of the Institute of
Asian Businesses (IAB) for three years before became the ABCC. He was then named as the ABCC’s first honorary chairman.
