Online gambling legislation was signed into law by President of Peru, Pedro Castillo, last year putting the newly regulated industry under the Ministry of Foreign Trade and Tourism (Mincetur). Te law in its previous form had come under criticism as it would only have applied to those operators with a physical presence in Peru. Tis meant that locally

based operators would be at an unfair advantage once the online gambling bill went into effect. Castillo was removed from office and charged with ‘rebellion’ after an alleged coup attempt in December. He was replaced by Dina Boluarte who, in July, signed Peru’s newly reworked gambling bill into law.


Te new bill was the result of many months work carried out in the economic committee in the house of deputies after Congresswoman, Lady Camones, called for improvements. In March Camones affirmed that the law in its present state would have excluded offshore betting companies, which she said made up as much as 70 per cent of the total number of operators.


Te modifications clarify certain terms of the bill, covers sports betting shops to a degree and


expands the scope of taxes. Te new bill also imposes prison sentences on those found to be operating online casino games or sports betting without proper authorisation from one to four years in jail. In addition, it also puts in place the obligation that platforms for online games and bets must be carried out using the domain with the extension ‘.bet.pe,’ ‘.bet,’ ‘.com,’ ‘.pe’ or ‘.com.pe.’

It is estimated that the bill will help the Peruvian State collect around US$43m a year. Final regulations as to the exact licensing terms and conditions have yet to be published.
