“AMENDMENT OF A CHAP- TER 616 FAIR CHARTER”


The charter of a fair association is


the formal document that gives all fairs in the state of Florida the legal authority to operate as a corpora- tion. Many fair associations are uncertain, if the need aris- es, on how to amend a fair charter. Florida Statute 616.05 is the specific statute that governs how a fair association may amend its charter. Typically, charter amendments are first proposed by the


fair board or membership as outlined in the fair associa- tion’s bylaws or charter. Once the amendments are passed by the fair board or membership, the following steps are required: (1) The amendments need to be submitted to the


Department of Agriculture and Consumer Services ("Department") for approval; (2) Assuming approval is obtained from the Depart-


ment, the amendments, or a summary of them, should be published in your local paper for four (4) consecutive weeks (3) Once publication has occurred, and the four (4)


weeks have passed, a petition should by filed by the fair with the local Circuit Court and a circuit court judge will need to approve and allow the amendments; (4) Upon the entry of an order by a local circuit court


judge approving the amended charter, a copy of the Order and amendments should be recorded in the County Clerk's office and also provided to the Department. Lastly, the fair should obtain a certified copy of the amend-


ed charter from the County Clerk of the Circuit Court for its own records.
