BISHTA Standards For anyone involved in the business of hot tub marketing, promotion and selling them, membership of the trade association BISHTA has been setting Standards in the hot tub industry since it was formed in 2001, originally basing the Standards on the relevant parts of the SPATA Standards. Thanks to the hard work of the BISHTA Technical Committee, these Standards have been updated in 2010 to include swim spas and they will be operational from 1 July. Members will have already received their free copy of the Standards and non members can purchase the Standards for £75 per copy.

Stakeholder account This facility was introduced following the impact of a similar version for SPATA members. The account is designed to deal with the stand-off situation in which a client might say “I am not going to pay until the installation is complete” to which the member might reply “I am not going to complete the installation until I am certain of being paid”. This situation is resolved by the agreed

balance due from the client to the member being paid into the BISHTA Stakeholder Fund and released to the member on satisfactory completion of the installation. In the event of a dispute as to what constitutes satisfactory completion there is further provision for the matter to be determined by a mediator agreed by both parties. Funds are held in a special bank account which

is administered by the BISHTA Managing Director and Accountant. Any interest accruing to the account is retained by BISHTA as a contribution towards the cost of the service which is thus self- funding except for mediation costs (if any) which are paid by the parties concerned in previously agreed proportions.
