Oceans cover over 70 percent of the Earth’s surface, and approximately 60 percent of all marine areas consist of the high seas, over which no state may assert its sovereignty. Thus, nearly half of the Earth’s surface is not subject to the sovereignty of any state. This article examines the Enrica Lexie case and the Lotus case as examples of how countries approach criminal jurisdiction on the high seas and the continuing development of the law of the sea.
