Regulations (GDPR) - five key questions for small businesses


General Data Protection Regulation (GDPR) is fast approaching and is going to affect every business in the UK. I know GDPR isn’t the most exciting subject, but we do need to understand how it can affect your business. The collection and management of data is a challenge for many organisations already, but with the new GDPR due to come into force in May 2018, SMEs need to act now to protect themselves. To help, we have answered five key questions below.


1. WHAT IS GDPR? The GDPR is Europe’s new framework for data protection laws. Since 1998 we have had the Data Protection Act 1998, which was enacted following the 1995 EU Data Protection Directive, but the new GDPR will become the law countries EU-wide will have to abide by.


2. WILL THIS STILL AFFECT US AFTER BREXIT? In short, yes. If you want to trade with the EU or hold any data about European companies or people then you will need to be GDPR compliant. As GDPR is a regulation, not a directive, the UK does not need to draw up new legislation. Instead, it will apply automatically and will likely be enshrined into UK law during the Brexit process.


3. WHEN CAN I PROCESS DATA UNDER THE GDPR? From May 2018 all data controllers must ensure personal data is processed lawfully, transparently and for a specific purpose and, perhaps most importantly, once that purpose is fulfilled and the data is no longer required, it should be deleted.

4. HOW DO I GET CONSENT UNDER THE GDPR? This is where the biggest changes are coming for most organisations, as many businesses have relied on an opt-out process rather than opt- in. In short, consent must be an active, affirmative action by the data subject, rather than the passive acceptance under some current models that allow for pre- ticked boxes or opt-outs. As an


example to this, if you are collecting data on your website you will need to rely on the visitor ticking a box to subscribe to your newsletter not untick it. Every organisation will be


required to keep a record of how and when an individual gave consent, and that individual may withdraw their consent whenever they want. You are not allowed to make it difficult for people to withdraw consent or make the task onerous, instead it should be simple and easy to follow.
