LEGAL
WHAT SHOULD YOU BE DOING? • Ensure your organisation has a top-down approach with management buy-in to all anti-bribery and corruption policies.
• Ensure your organisation has clear and unambiguous anti-bribery and corruption policies in place detailing your statement of values and anti-corruption culture. Ensure your policy is regularly reviewed.
• Ensure all staff are aware of, and have been trained and updated on, your anti-bribery and corruption policy and that it is easily accessible.
• If appropriate, appoint a compliance officer with responsibility for oversight of your anti-bribery and corruption policy.
• Ensure your whistle-blowing policy and procedures provide employees with a safe and confidential method of reporting instances of bribery and/or corruption.
• Ensure individual accountability of staff and that disciplinary procedures expressly provide that your organisation will take suitable action for violations of its anti-bribery policies.
• Ensure your organisation has clear policies on corporate hospitality, gifts, political contributions and lobbying.
• Consider whether your organisation’s reward and bonus structure encourages a corruption culture.
• Ensure you undertake appropriate due diligence around the selection and appointment of third parties. They will be associated with your organisation for Bribery Act purposes and their actions could impact on your organisation.
• Consider including standard clauses in commercial contracts that prohibit bribery and corruption. There should also be a commitment to making it explicit that your anti-bribery and corruption policies apply to business partners.
• In relation to any mergers or acquisitions, ensure due diligence is undertaken in the country in which the business will be conducted and that any potential business partners or agents are properly vetted.
Change to Chamber’s HR and legal service
The Chamber has made changes to its Chamber HR and Chamber Legal Services, which came into effect as of 1 October. The services were provided
by two suppliers, Qdos and Composite Legal. As of 1 October, the Chamber has contracted exclusively with Qdos to provide all the services under the current banner; as well as a lot more besides. Today, The Qdos Group has
grown to a £28m turnover business consisting of insurance, business compliance, consultancy, legal and accounting services. Qdos will provide four employer-
focused services to all Chamber members, which are included within the membership subscription fees, meaning members are covered. They are: • Chamber HR • Chamber Health & Safety • Chamber Legal • Chamber Tax and VAT Each of these four separate
services comprise a free helpline
and a bank of over 700 downloadable documents and templates. Wrapped around all this is legal expenses insurance with a limit of £1m and no excess. David Pearson
(pictured), the Chamber’s Director of Partnerships and Membership Services, said: “We are delighted to be pressing ahead with a very dynamic and comprehensive model with
Qdos, aimed at providing an outstanding level of support for Chamber members. Without wishing problems on any members, we hope businesses will make use of these great new services, especially the downloadable documents and templates. Qdos is a renowned and trusted locally- based organisation that will add significant value and peace of mind to members on a raft of important issues that can affect businesses of all shapes and sizes.”
