Prosecution options via EA Enforcement include: • Issuing a warning • Statutory enforcement notices • Prohibition notices • Suspension, or revocation of permit • Variation of permit condition • Injunctions and civil sanctions • Formal caution • Prosecution • Combination of above, as sanctions


One area which should be expanded is the use of Enforcement Undertakings in lieu of a prosecution, which avoid a criminal conviction and reduce the costs involved.


Each case is obviously diff erent, but it is only possible to get the right results by hiring the appropriate experts (including legal) from the early stages, so my advice is to involve your legal team from the outset.


To obtain this, the client has to be proactive and not delay in making a suitable proposal on the form, so that the EA can consider accepting an undertaking.


Essentially, this is an off er to restore and remediate any damage caused by an off ender. It may involve paying compensation and always the EA costs, but avoids a prosecution if complied with.


If the EA have investigated and formed the view that off ences are or have occurred, then this is a valid alternative to prosecution.


It will be interesting to see if any expansion of the undertakings regime has taken place since it was introduced in April 2015, and whether the revised Sentencing Guidance could have infl uenced this procedure.

You wouldn’t normally buy a diesel car, then expect to run it on petrol. Nor would you ever expect to drive without a licence, or road tax.
