Page 8 What is the guarantee on building defects?


Once you receive the keys to your property it is advisable that you check for structural or building problems. To claim for any damages and request that these are repaired the buyer has the following periods:


In buildings built before May 2000:


l 6 months from when you receive the property for any defects that don’t affect the main use of the property. l 10 years from the finalising of construction on defects in any essential structural issues. On properties built after May 2000:


l 1 year on defects that affect the finishings of the property, such as electricity,


paint etc. l 3 years on defects that deem the property unliveable, such as damp. l 10 years on defects that affect the structure of the building.


As the buyer you have 2 years in which you can request the repair of the defects as long as you claim within the guarantee period.


The First and Second Occupancy Certificates


This is a document issued by the Town Hall that indicates that the property is habitable and appropriate for the use it is intended for. The first occupancy certificate is normally issued on the finalisation of the construction by the promoter and is essential in order to contract


the


household supplies. It is normally valid for a period of 5 years. The


second


occupancy certificate can


be applied for when the first one expires and is needed in some cases to contract household supplies on the second and consecutive sale of the property. To apply for one you will need to have an architect’s certificate. The architect will normally make the application in the Town Hall for you.
