We asked Keith Spinks, secretary general, European Travel Retail Council, to answer some questions about the new EU legislation.
What are the new regulations? The Regulation on the provision of food information to consumers updates and extends existing EU legislation on food labelling and the provision of nutrition information and replaces them with a single Regulation.
When do they come into force? Transition measures provide that once the legislation is in force (expected later this year), food companies will have three years to comply with the majority of the new rules and five years to comply with the mandatory nutrition declaration.
What are the implications for onboard caterers on international routes? Non pre-packed foods – which includes the catering industry and, I assume, meals sold or provided on aircraft, are exempt from the majority of the new labelling rules, with the exception of rules on allergen labelling.
How will this affect the industry? From 2014 onboard caterers will be required to provide information on potential allergens in their products. The 14 different classes of allergens or ‘Substances or products causing allergies or intolerances’ are listed in Annex II of the Regulation. It is for Member States to decide how the information must be made available to consumers. It is the responsibility of the industry’s suppliers to provide the business with adequate information on allergens so that this
can then be communicated to their consumers. It is for individual EU Member States to decide whether or not to extend other elements of the Regulation (i.e. the nutrition declaration) to non pre-packed foods. If they decide to do so, these measures and their form of expression and presentation must be communicated to the European Commission.
What are the penalties for ignoring the regulations and is this an option? Member States will carry out official controls in order to enforce compliance.
What happens next? The Council will formally vote on the Regulation in the autumn and the expectation is that the Regulation will then be published.
