Un juzgado en Brasil ha ratificado la denegación de una licencia de póker en São Paulo. La Cámara 13 de la Ley Pública del Tribunal de Justicia de São Paulo apoyó de forma unánime una decisión del juzgado después de que denegara una licencia de negocio a un establecimiento de póker.


El Diputado de Brasil João Carlos Bacelar Batista quiere que los artículos 50 a 58 de la Ley de Contravenciones Criminales sean revocados. "La Ley de Delitos Criminales prohíbe juegos de azar privados. En otras palabras, en la práctica, en Brasil los juegos de azar no están prohibidos, el Estado tiene un monopolio", dijo.


Wynn Hotels & Resorts podría estar a punto de realizar una gran inversión en la República Domini- cana. Según oficiales de la compañía, Wynn está en conversaciones con líderes de empresas para adquirir 12 hectáreas para construir un hotel de 9000 habita- ciones en un proceso de 3 fases. Sun Dreams ha sufrido otro contratiempo en el Tribunal de Apelaciones de Valdivia al rechazar una apelación presentada por la firma chilena- sudafricana por los daños sufridos por el hotel casino en la ciudad de Valdivia, durante disturbios entre manifestantes y policía.

BRAZIL LEGISLATION Another Delay for Sports Betting


Te Attorney General's Office is in favour of a public licence tender for the operation of sports betting, while SECAP supports a direct authorisation model


Te Brazilian government held a public consultation on the regulation of sports betting at the beginning of March. According to a consultation notice published in the Official Gazette, interested parties had to submit proposals by March 6. Tis was the third public consultation on the subject during which time major changes are expected within the leadership of the Secretariat of Evaluation, Planning, Energy and Lottery (SECAP).


In January it was reported that the government would issue a decree in March to regulate sports betting, which, if confirmed, would allow fixed- odds bets to be offered to the public later this year. At that time, the Undersecretary of Prizes and Sweepstakes, Waldir Marques Júnior, reported that the text of the alleged decree was almost ready.


However, there may have been some disagreements between the Attorney General's Office, in charge of the legal advice for the Ministry of Economy, which is in favour of a public licence tender for the operation of sports betting, and SECAP which supports a direct authorisation model.


Brazil Court Denies Poker Licence


A court in Brazil has upheld the denial of a poker licence in São Paulo. Te 13th Chamber of Public Law of the São Paulo Court of Justice unanimously backed a court decision after it had denied a poker room a business license. Te club had aimed to promote tournaments, games and other activities, with an emphasis on poker which it considers as a “sport of the mind” as opposed to a game of chance.


According to the case file, the plaintiff requested authorisation to operate in the Municipality of Adamantina in São Paulo, which in turn denied the request, as it argued that poker was a game of chance and therefore a criminal offense. Te club filed a lawsuit asking for the granting of the permit. Tis was consequently dismissed by the 1st Court of the District of Adamantina (SP) and then upheld by the São Paulo Court. Te appeal's rapporteur, Judge Maria Isabel Caponero Cogan,


dismissed the appeal, despite the appellant's statements in defence of poker as a sport. "Indeed, there is no denying that the game of poker requires the intellectual dexterity of players, involving logical reasoning, mathematical calculations, statistical checks, emotional control and other skills," wrote the magistrate. “On the other hand, it cannot be denied that the game also involves the element of 'luck' in terms of receiving the cards distributed to the participants and the positioning of the player on the gaming table. In that respect, the qualification of poker as a game of chance cannot be totally excluded. ”


Te decision could have wider implications if it is mirrored by other local governments. Poker is hugely popular in Brazil. Tere are currently around seven to eight million players signed up to poker clubs. In 2012, poker was officially recognised as a game of skill by the Brazilian Ministry of Sport.


In mid-2019, two public consultations were opened to discuss the draft decree. However, there was no agreement on some points, such as the requirement of a guarantee reserve of R$6 million from the sportsbook operators.


Waldir Eustáquio Marques Junior said companies from countries such as England, Italy, the United States, Greece, Portugal and Denmark had already shown interest in operating sports betting in the country but are awaiting regulation.


Provisional measure 846/18 will allow for both online and land based sports betting as well. Te bill deals mainly with how lottery funds are distributed giving more priority to National Security. A much larger proportion of resources operated by Brazil’s largest state owned bank and lottery operator –the Caixa Econômica Federal (CAIXA) will be earmarked for public security while the bill seeks to raise additional income for the government by green lighting sports betting. It is believed that the Ministry of Economy has been looking at international regulatory models to understand what framework would be best suited to Brazil.


Paraguay


Mid-March, the National Gambling Commission (CONAJZAR) urged casino owners to abide by the Executive’s order to suspend the activities of gaming centres for 15 days. “We trust that the sector will assume the commitment to greater social responsibility,” the board said in a statement.


Te suspension was issued by Health Minister Julio Mazzoleni in a televised address. It went to all owners and representatives of casinos, game rooms and other venues where people can meet in large numbers and affects private and public educational institutions, concerts and football matches amongst other mass events and was in effect until the start of April.


At the time of print, there were five confirmed cases of coronavirus in the country, two of the patients at home, three of at boarding schools, and two of the patients were in intensive care.
