PARAGUAY LEGISLATION New Requirements Stifling Competition
Te National Competition Commission has questioned the country’s new bidding requirements believing them to be anti-competitive.
Chile - Possible asset sale for Enjoy Enjoy is looking into potential investors after its merger with Dreams failed to come to fruition. According to local press reports the company is looking for potentially interested parties to sell assets through the acquisition of shares. In a memo sent to the Commission for the Financial Market (CMF), Enjoy alluded to a news story from Chilean newspaper, Diario Financiero, which reported that the firms Euroamérica and Ponte, majority shareholders of Enjoy, had put their operations on sale in Chile and Uruguay.
In the memo sent on August 1 and signed by the general manager of the company, Eliseo Gracia Martínez, Enjoy stated that "after the merger with Dreams was not carried out, it has been working on the realisation of long-term strategic plans in order to resume profitability and in the analysis of possible alternatives for a strategic transaction. Within the framework of such plans, the financial advisor ASSET Chile was hired, which is exploring the existence of interest of potential investors in implementing a possible combination of businesses at the level of share capital and/or one or more of the company's assets.”
The news comes after reports emerged that Enjoy may have put its casino in Punta del Este up for sale by its new owners, Euroamérica and Penta. In January 2022, Enjoy and Dreams, the two largest casino operators in Chile, finalised their agreement to merge the two companies. However, in June 2022 the Chile’s national competition authority (FNE) put the brakes on the merger.
The FNE said it needed more time to analyse the merger after initially finding that it could possibly reduce competition in the market and have a negative effect on consumers and other casino operators. In April, Dreams and Enjoy finally informed the CMF that they would remain as separate companies.
Colombia - Coljuegos appoints new President Marco Emilio Hincapié Ramírez has become the new president of Colombia’s gaming board, Coljuegos, after the previous head of the board left two months ago. Prior to taking up the presidency, Hincapié was manager of the Bogotá Lottery, magistrate of the National Electoral Council and deputy to the Tolima Assembly, as well as holding a number of other public positions.
The previous head of the board, Roger Carrillo, resigned in May having been in the position for just over two months. The position was temporarily filled by Sammy Libos Zúñiga who previously served in the Ministry of Finance.

Te National Competition Commission (Conacom) has published a statement questioning the bidding requirements for sports betting in Paraguay and recommending changes to how it should be carried out in the future.
According to the entity, the conditions established by the National Gaming Commission (Conajzar) do not encourage competition within the sector because operators have to pay in return for the terms and conditions. In addition, the way it is framed means foreign operators are blocked from taking part. “By providing that the specifications and conditions for the exploitation of games of chance have a cost, Law No. 1016/97 on Games of Chance establishes an unjustified barrier to competition, which prevents eventual bidders from knowing the conditions before acquiring a copy of the document," Conacom outlined.
To reverse the situation in the sports betting market, the entity suggested that "the Legislative and Executive Branches take the appropriate measures to review the regulations." According
to Conacom, the restriction on competition, which involves the cost of acquiring the specifications, must be abolished "unless it is duly justified based on the principles of necessity, proportionality and non- discrimination.”
Another factor Conacom highlighted as detrimental to the process was "the exclusion of international bidders and the consideration of their experience in consortiums." Tis isn’t the first time the commission has taken aim at the country’s gambling laws. In January, it recommended that the government review Paraguay’s gambling law because it allowed for licence holders to hold a monopoly over instants, pools, sports betting and casinos.
Conacom concluded at the time that the law established regulatory barriers to competition by establishing the right of exclusivity in the running of certain games of chance for operators and by establishing geographic barriers regarding where operations such as bingo halls may be constructed.

Te Uruguayan executive branch has authorised bids for the construction of a hotel and casino in the city of Paysandú. Te project, which has a planned investment of around US$22m, will have an event and convention hall, restaurants, commercial premises and a casino, and will be built where a cinema previously stood.
Te bidding process for the casino was announced by the authorities and will be developed by the Ministry of Tourism whilst the adjudication or rejection of offers will be carried out by the Executive Branch.
Te Secretary of the Presidency of Uruguay announced the construction of the new hotel and casino in January. Te announcement was made by the Secretary of the Presidency of Uruguay, Álvaro Delgado, together with the mayor of Paysandú, Nicolás Olivera, announcing the news via Twitter, now X.
