Te Chamber of Deputies of Chile has approved online gambling bill 14838-0 which is now heading to the Senate for further discussion.
Argentina - Santa Fe approves online bill The Senate of the province of Santa Fe sanctioned several bills sent by the Executive Branch, headed by Governor Maximiliano Pullaro. Among them was the online gambling bill. Online gaming was approved without any changes. The initiative, which was approved unanimously, “establishes regulations for the development and exploitation of the activity of games of chance, sports betting and sports predictions, online or in virtual form , which are carried out through digital, electronic, computer, telematic, interactive, telecommunications media, platforms, and those that are developed in the future.”
The bill was promoted by Fabián Bastia and Marcelo González both members of the ruling party of governor Maximiliano Pullaro. The bill establishes that taxes increase from the current 10 per cent to 15 per cent GGR and that 50 per cent of the money collected will be allocated to gambling prevention and awareness campaigns. It also allows for online sports betting. The project allows the current licence holders permission to continue to operate online casino games “but only in relation to the games already authorised in physical rooms, for a period coinciding with the current concession. That is, when the physical casino concession expires, the same will happen with the virtual licence.”
It also establishes that the application authority namely the Santa Fe Lottery Social Assistance Fund “can develop its own online platform, or carry out a national and international public tender.” And it clarifies: “If within 180 days of this promulgation the enforcement authority has not implemented the exploitation itself, it must call a bidding process.” The new law was put forward days after the new government took office, with members belonging to the ruling party drafting the text of the new law. In 2020, Governor Omar Perotti awarded online gaming to the officially authorised physical casino operators in the province: the City Center of Rosario, the Casino Melincué SA and the Casino Puerto Santa Fe SA.

Te Chamber of Deputies of Chile has approved online gambling bill 14838-0 which has subsequently been sent to the Senate for further discussion after receiving 80 votes in favour, 36 against and eight abstentions.
Te Finance Commission of the Chamber of Deputies, which had been tasked with analysing the project to establish a regulatory framework for the online gambling sector, had sent its approved online betting bill for consideration to the house at the end of November. According to local press, the initiative aims to establish a competitive market and make the origins and destination of the resources obtained by the industry more transparent. It also grants greater powers to the Superintendency of Casinos and Games to supervise the activity.

Mexico AIEJA plans next moves against slot ban
Te President of the Association of Permit Holders, Operators and Suppliers of the Entertainment and Gambling Industry in Mexico (AIEJA), Miguel Ángel Ochoa has come out against the recent ban on slot machines put in place by the government of President Andrés Manuel López Obrador.
Ochoa said that the AIEJA was working on two strategies to confront the ban. Firstly, the presentation of legal appeals, and secondly, the promotion of a new Federal Betting and Raffles Law. "At this moment, the two actions are: the issue of protection, on the one hand; and the issue of promoting a Federal Betting and Raffles Law,” Ochoa said. According to the AIEJA, the ban on slots represents 85 per cent of the sector's business.
Ochoa expressed concern about the long-term impact of the ban, as it will affect the majority of
casinos whose permits expire between 2028 and 2033. Additionally, starting in 2038, no more permits will be renewed.
Ochoa highlighted the obsolescence of the law in force since 1947 and expressed the intention to work on a new bill that reflects the current reality of the sector. Tese discussions are expected to take place beginning in February 2024, during the last session of the current Congress.
In November, the government of President Andrés Manuel López Obrador banned slots in casinos and other gambling facilities. However, the reform will not be retroactive, so casinos will still be able to use them for the time remaining on their permits. Tese licences can only have a maximum validity of 15 years. Once this time passes licences won’t be eligible for renewal or extension.
Associations representing the sports betting sector have criticised the exclusion of online casino games from the Brazilian sports betting bill which was approved by senators last week. With 37 votes in favour and 27 against, the senators included an amendment by Carlos Portinho excluding online casino games from the bill.
André Gelfi, President of the Brazilian Institute of Responsible Gaming (IBJR) said: “It was really bad. Basically, they will regulate 30% of the market, which only has sports betting. Today, 70 per cent of operators operate with online games. Te vast majority offer both.”
André Gelfi claimed that, if the senator's amendment is approved, most of operators that currently operate in the country from abroad will have no interest in obtaining a licence. “We will have 75 to 80 per cent of the market unregulated, with a lack of control, unlimited gambling, among other problems.”

Te Undersecretary of the Treasury, Heidi Berner, said: “Te main objective of this initiative is to regulate the online betting market through the delivery of an administrative authorisation and, above all, it seeks to safeguard compliance with the requirements that aim to avoid commission of crimes, money laundering and at the same time protecting users, especially children and adolescents, for which there will be a National Responsible Gaming Policy.”
Te bill creates new sources of financing for sports as authorised platforms must pay an annual tax of two per cent of gross income on bets made on sports. Te proposed tax system for online gambling platforms is based on the current regime for land-based casinos via VAT. As with gaming casinos, a specific tax of 20 per cent will be applied to online platforms.
