Terminal Dilapidations


When a commercial tenant signs a lease for a new property it is often exciting times and tenants may not realise the significance of the lease clauses they have signed up to.


When a lease comes to an end many tenants receive a terminal schedule of dilapidations, which is a list of work the landlord considers needs completing by the tenant in accordance with the lease. The tenant may be required to complete the work or pay the landlord damages.


For some tenants one of the biggest surprises may be a requirement to put the building into a full state of repair, even if the building was not in that condition when they took it on.


A tenant may have taken photographs when they moved in, however, unless these are in a schedule of condition which is specifically referred to in the lease it is unlikely these will be taken into consideration and can be a common cause of dispute.


Dilapidations is a complex area and we would recommend a preventative approach, advising potential new tenants to take professional advice on any lease and to obtain a schedule of condition before signing up. Where tenants already have a lease, we recommend they consider their liability 18 months prior to lease expiry.
