Below is an outline of the legislation that affords protection to the aforementioned species. It should be noted that regulations might change.


European protected species (EPS) afforded protection under The Conservation of Habitats and Species Regulations 2010 are highlighted in bold in the bullet list above. Protection afforded under this regulation makes it an offence for anyone to deliberately capture, injure or kill any such animal. Their breeding sites or resting places are protected under Regulation 41. During surveys of the East Anglia ONE transmission and Convertor Station EPS recorded included bat(s), otters and great crested newts.

The water vole is now fully protected through its inclusion in Schedule 5 of the Wildlife & Countryside Act 1981 (as amended) for some offences and recently extended (6th April 2008), to include Section 9. This makes it an offence to intentionally kill, injure or take (capture) a water vole or intentionally or recklessly damage, destroy or obstruct access to any structure or place which water voles use for shelter or protection or disturb water voles while they are using such a place.

All native reptiles are protected under theWildlife and Countryside Act 1981 (as amended). It is an offence to kill, injure or sell any of the six native species. The Wildlife and Countryside Act 1981 (Variation of Schedule 5) (England) Order 2008 extended protection afforded to water voles. This made it an offence to kill, injure or take (section 9(1)); be in possession or control (section 9(2)); damage or destruction of its places of shelter, or disturbance while such animals are occupying places of shelter (section 9(4)), and sale, possession or transport for the purpose of sale, and advertising the buying or selling of such animals (section 9(5)).

Badgers and their setts are protected under the Protection of Badgers Act 1992, which makes it illegal to kill, injure or take badgers or to interfere with a badger sett with a sett defined as “any structure or place which displays signs indicating current use by a badger”.

Specially protected or Schedule 1 birds are fully protected under the Wildlife and Countryside Act 1981 (as amended) meaning they are protected at all times and it is an offence to intentionally or recklessly disturb at, on or near an „active‟ nest.
