alongside the onshore cable route and HDD crossing points that are attractive as a food source to Brent Geese.

In the circumstance that construction works take place outside of those months when Brent Geese are present in and around the Deben Estuary then there is no need for the two additional measures described below.

In the circumstance that all the cropping is of a type that is not used by Brent Geese then there is no need for the two additional measures described below.
If potentially disturbing construction works take place within all or part of the period September to March inclusive then the two additional measures set out below will be implemented. Potentially disturbing construction works are defined as those operations during the construction phase that produce percussive noises (short, sharp, loud and resembling gunshot) such as earth moving and tipping and/or require construction workers to operate from outside of vehicles potentially in sight of Brent Geese. Operations excluded from that definition include the use of the haul road to transport workers and materials between locations along the route of the onshore works.
i) Moving screen for 200 m either side of earthworks
43. A visual and acoustic screen (to avoid line-of-sight disturbance to feeding Brent Geese and to reduce noise propagation to feeding locations) would be installed alongside any locations between the crossing of the Deben Estuary and the Queen’s Fleet where potentially disturbing construction works are taking place and for a distance 200 m along the route either side of those works. This visual and acoustic screen would be moved at appropriate intervals to ensure the distance between the location of the works and the end of the screen remains a minimum of 200 m.
ii) Construction restriction during ‘severe weather’
During periods of severe weather (prolonged cold) potentially disturbing construction works will stop along the Deben Estuary in adjacent agricultural land along the cable route. Works may proceed during this period only with agreement from Natural England and dependant on a monitoring programme being able to sufficiently demonstrate that agricultural land being used by flocks of 100 or more Brent Geese, in the preceding four weeks, are located at a sufficient distance to minimise disturbance. This will provide an additional level of avoidance of disturbance of Brent Geese during a period when they will be particularly stressed. The definition of ‘severe weather’ will be the same as that used to implement the Statutory Suspension of Wildfowl Shooting in Severe Winter Weather measure under the Wildlife and Countryside Act.
44. EAOW will also explore the option in the period between consent of the DCO and construction works beginning to negotiate an agreement with one or several landowners
