Read All Drug Testing- Related Laws It’s easy to see that a typical state drug testing law contains a lot of detail. When reading a statute the best advice is to read the entire law. And it’s not enough, as was pointed out in the last issue of DATIA focus, to simply read a state’s drug testing law. In many states, workers’ and unemployment compensation laws contain drug testing language which can impact a company’s writen policy. For example, when reviewing Missouri Revised Statutes, Chapter 288 Employment Security, Section 288.045 we find the following upon close examination:
“Any employer that initiates an alcohol and drug testing policy aſter January 1, 2005, shall ensure that at least sixty days elapse between a general one-time notice to all employees
that an alcohol and drug testing workplace policy is being implemented and the effective date of the program.” (Section 288.045 (10))
Wow! Sixty days advance notice prior
to implementing a drug testing program. Tat’s a unique detail not found in a specific drug testing law but in an unemployment compensation law. And Missouri is not the only state with such a requirement.
Conclusion No doubt it takes a lot of time to review state drug testing laws and become familiar with their unique requirements. Tis is particularly true if you are a multi-state employer or a drug testing provider doing business with companies in many different states. But it is well worth the investment of time to understand the legal requirements
