Problems with the car If the car develops problems after the purchase take it back immediately. Remember, if you purchased from a dealer you have the right to a refund or repair if: •

The car is not fi t for purpose or is not roadworthy; or
If you discover that the car isn’t as the dealer described it.
If you purchased from a private individual your rights are limited and you will only be able to take it back if the description was misleading or simply incorrect. So, if the seller told you that the car had a brand new exhaust and it later turns out that this was not true you can claim a refund. Regardless of where you purchase the car from, it is a criminal off ence to sell a car that is not roadworthy.
Important things to keep As a lawyer I am always thinking about the worst-case scenario and when buying a car you should do the same. This means being prepared for things to go wrong. With this being the case always keep everything associated with the purchase, including: • A copy of the car advertisement and descriptions of the car given to you; and
• A copy of all paperwork, including receipts.
