Hacienda nombra las autorizaciones de los sitios de “bets”
La Secretaría de Premios y Apuestas del Ministerio de Finanzas (SPA-MF) de Brasil dio a conocer la lista de sitios de apuestas deportivas que podrán seguir operando en Brasil hasta finales de este año, bajo el objetivo de considerar en el proceso de adaptación a los nuevos reglamentos creados por el MF para aquellas empresas que hasta la fecha han solicitado autorización, a través del Sistema de Gestión de Apuestas MF (Sigap), para explorar la modalidad de lotería de apuestas de cuota fija, y han demostrado interés en cumplir con los reglamentos y la legislación vigente.
La SPA-MF también notificó a los 26 estados y al Distrito Federal solicitando que envíen las listas de empresas autorizadas a nivel estatal. En la lista nacional, hay 89 empresas con 193 apuestas (marcas) respectivamente. La lista de estados tiene seis compañías con seis sitios de apuestas, respectivamente. Los sitios que no están en la lista publicada por Hacienda ya no pueden ofrecer apuestas a nivel nacional, y solamente podían permanecerán en el aire por diez días, y únicamente para facilitar la solicitud de la devolución del dinero que se encuentra depositado a nombre de los apostadores que lo reclamen, y después del 11 de octubre, tales sitios han comenzado a ser clausurados con la ayuda de la Agencia Nacional de Telecomunicaciones (Anatel).
Al final del período de transición, que se extiende hasta finales de este año, la SPA-MF publicará la lista definitiva de empresas y sitios que estarán autorizados a operar a partir del 1 de enero de 2025, cuando en efecto comenzará el mercado regulado de apuestas deportivas en Brasil, bajo la Ley N° 13.756/2018, la Ley N° 14.790/2023 y las más de diez ordenanzas reglamentarias creadas por el MF este año.
Con anterioridad, las primeras empresas aprobadas en definitiva deberán pagar por cada autorización o licencia la suma de R$ 30 millones (US$5,5 millones) para poder comenzar a operar, a partir de enero, debiendo cumplir con todas las normas para combatir el fraude, el lavado de activos y la publicidad abusiva, entre otros. El próximo año, las empresas que en definitivo han sido autorizadas comenzarán a utilizar sitios web con la extensión
bet.br. Luego, se analizarán las solicitudes para explotación de las “bets”, que fueron recibidas después del 20 de agosto.
A la fecha de publicación de la última ordenanza, el 17 de septiembre de este año, SPA-MF recibió un total de 117 solicitudes de 112 empresas, y estas tuvieron hasta las 23:59 horas del pasado lunes (30/9) para informar a Hacienda de sus marcas (apuestas) que están en actividad y qué sitios (dominios de internet) utilizan durante este periodo de adaptación, para que el MF pudiera armar la lista que fue publicada el martes 1ro de octubre. Quienes solicitaron la autorización, pero aún no estaban trabajando, deberán esperar para iniciar la operación en enero, si logran conseguir la autorización del MF, sujeto al cumplimiento de todos los requisitos.

BRAZIL Treasury authorizes registered “bets” sites
Brazil’s Secretariat of Prizes and Betting of the Ministry of Finance (SPA-MF) released the list of sports betting sites that will be able to continue operating in Brazil until the end of this year, with the objective of adapting registered sites to the new regulations created by the MF for those companies that to date have applied for authorization, through the MF Betting Management System (Sigap), for exploitation of fixed-odds betting lottery modality – sports betting - and that have shown interest in complying with current regulations and legislation. SPA-MF also notified Brazil’s 26 states and the Federal District that they send the lists of authorized companies registered at the state level, and the information submitted to date by the responding States was included in the approved list. The information submitted to date by the states was included in the MF list. There are 89 companies with 193 bets (brands) respectively on the National List. The list of states has six companies with six betting sites, respectively.
The sites that are not on the list published by the Treasury can no longer offer sports bets in Brazil, and could only remain on the air for ten days in order to facilitate requests for the refund of monies that were deposited by the bettors who are able to claim it back. However, after October 11, such sites have begun to be closed down with IT support from the National Telecommunications Agency (Anatel).
At the end of the transition
period, which runs until the end of this year, SPA-MF will publish the final list of companies and sites that will be authorized to operate as of January 1, 2025, when the regulated sports betting market in Brazil will indeed begin, under Law No. 13,756/2018, Law No. 14,790/2023, and the more than ten regulatory ordinances created by the MF this year.
Prior to begin operations, the first companies that have been fully approved will have to pay the sum of R$ 30 million (US$5.5 million) for each authorization or license to be able to start operating on January 1st, after complying with all the regulations to combat fraud, money laundering and abusive advertising, among others. Next year, companies that have been fully authorized will start using websites with the
bet.br extension. Then, all other applications for the exploitation of “bets”, which were received after August 20, 2024, will be processed before full authorization.
On the date of publication of the latest ordinance, on September 17 of this year, SPA-MF received a total of 117 applications from 112 companies, and they had until 11:59 p.m. on Monday (9/30) to inform the Treasury which of their brands (bets) were operating, and what sites (internet domains) they are using during the adaptation period, to enable the MF to put together the list that was published on Tuesday, October 1. Those who applied for authorization, but were not yet operating, will have to wait to start operations in January, if they manage to obtain authorization from the MF, subject to compliance with all Brazil’s regulations and legal requirements.
